Hi,

I have two questions:

#1 can I translate some documents like Birth Certificate, Marriage Certificate and Military Document, and notarize it?

#2. Which affidavit do I file for my husband:

I-134 or I-864. I applied for the I130 & I 129F K-3 Visa.

1) Yes, you can do the translation yourself, you don't even have to notarize it. Just put a "certification statement" on it such as:

"I certify that the translation is complete and accurate and that I am competent to translate from the foreign language into English." Replace "the foreign language" with the correct language. Then sign it.

oh you dont need to go to a professional translater that certifies and stamps documents needing translation for the process???

Nope, just someone that understand (can read and write) English and the foreign language. USCIS doesn't ask you to use a "certified translator." No such thing as a USCIS certified translator. They ask for a certified translation, which is certified with a statement like that posted above.

The affidavit will depend on the ultimate visa you will apply for

K3 = I-134 (I-129F petition)

CR(IR)1 = I-864 (I-130 petition)

but i am assuming you can not use a family member? my mother is from germany as is my husband. she could translate all she speaks fluent english and german but i had thought i read you can not use family members. anyone know if this is accurate?

I think it would be wise to use somebody other than family members for any documents submitted with the petition. You need to comply with the local Consulate's specific expectations for later documents needed at the Consulate stage. Police reports, for example, may require an official local government certified translation. This varies by Consulate.

yeah, that's pretty cool, considering that each page of official notarized translation costs about $25 (here, at least)

last week before dirk and i got married we were told by my town clerk we needed his birth certificate and previous divorce all translated by a professional translator service before she could issue us our marriage license.. i had never thought about that! so we ran to my city and found someone who did it in two days for us. the cost for one small page and two bigger ones... $190 !

What I think you are thinking of is a translator for the AOS interview here in the States. If your SO's first language is other than English, they have the right to bring a translator to the interview. It is your and your spouses responsibility to find the translator and arrange for them to be at the interview. Why?, because they don't have resources or staff to handle translating for the many languages that they do AOS interviews for at the local offices. For AOS, they don't care that your SO has developed perfect fluency in English to answer all questions but that he/she can answer all the questions satisfactorily to prove a bona fide marriage. You cannot, for obvious reasons serve as this translator, nor can any members of your family. They would be less sure if the answers were fudged to fake a bona fide marriage in such cases.

Translating docs is a totally different story. Consulates/embassies may have different requirements so check for the docs being sent there, but you yourself or a family member can translate docs submitted with petitions. Many VJers have done it successfully.

Issuing marriage licenses is controlled by local/state authorities in the country where the marriage takes place and may require professional translations.

in order to get married here in brazil, chris had to have his parents send us a copy of his birthday certificate which was validated at the brazilian consulate in chicago, then officially translated to portuguese, it was such a pain in the ###

Any document containing foreign language submitted to the Service shall be accompanied by a full English language translation which the translator has certifiedas complete and accurate, and by the translator's certification that he or she is competent to translate from the foreign language into English.

FYI -

I don't know about prices in other countries, but my wife had her documents translated by a "certified translator" in Lima, Peru, and sent everything to me translated and all. It only costed about 10% of what it would have costed here in the States to have it translated by someone down there (as a sidenote, my lawyer was shocked at how well it was put together and how cheap it was). So if anyone needs documents translated and you aren't 110% confident that you can do it yourself (as I wasn't at the time), you may want to have your spouse check what it would cost in their country before paying an outrageous fee here.
