Does anyone know how this works ? My wife is from Ukraine with a Ukrainian passport. She just received her permanent resident card last week (we live in Michigan, USA). We are going to visit her parents in Ukraine, but the flight back we stop in Germany and need to stay overnight there because the next flight back is the morning after. Will this be a problem for her since she only has a Ukrainian passport ?

GERMANY (DE)

Visa not required when transiting:

- within 24 hours through Frankfurt or Munich; or

- on the same day between 04:30 and 23:30 through Dusseldorf

(inbound carrier must provide prior notice) or Hamburg;

and provided:

a. continuing to a third country by same or first connecting

aircraft; and

b. arriving from and departing to a non-Schengen State (see:

TIRGL/SCHS ); and

c. not leaving the transit lounge; and

d. holding ticket with confirmed reservation and all travel

documents required for next destination.

Transit through any other airports will require a (transit)

visa.

Transit without visa not available if making more than one

intermediate stop in Germany.

Non-compliance with the transit requirements (incl. forged

documents) results in:

a. fines for the transporting carrier varying between

EUR 1,000.- and EUR 2,500.- per passenger;

b. penalties of up to EUR 10,000.- per passenger in the event

that the carrier was negligent in taking the necessary

precaution to the end that the passenger complied with the

entry requirements; and

c. deportation to country of origin or any other place where

the person is admissible. Detention costs at carrier's

expense.

U.S.A. (US)

Passport required; or

- if stay outside U.S.A. was more than 1 year: re-entry

permit issued by U.S. authorities viz. Permit to Re-enter

the United States" required. The document has the same size

as the U.S. passport; or

- if stay outside U.S.A. was less than 1 year: Permanent

Resident/Resident Alien Card (Form I-551).

Visa not required, provided holding:

1.- Valid Permanent Resident/Resident Alien Card (Form I-551),

provided stay outside U.S.A. has not exceeded 1 year (to

be determined by Immigration Inspector upon arrival); or

2.- An expired Permanent Resident/Resident Alien Card (Form

I-551) with a 10-year expiration, acceptable only if the

alien has not been absent from the U.S.A. more than 180

days.

This exemption does not apply to Conditional Residents

holding I-551's with 2-year expiration. In addition to

the 2-year expiration, these cards are identified by the

Category Code "CR(numeral)". Generally the numerals are

1, 2 or 6. The Category field is to the right of the

birthdate field on the front of the I-551.

Conditional Residents can be boarded with an expired

I-551 if holding a I-797 Notice of Action extending the

card for an additional year.

Expired Form I-551 is also accepted if holding:

a) a Transportation Letter issued by a United States

Consular or Immigration officer;

B) a civilian or military official travel order issued

by the United States Government;

c) or is included as dependent spouse or child on the

civilian or military official travel order issued to

the alien's spouse or parent by the U.S. Government.

3.- Re-entry permit (same size as a U.S. passport) issued by

U.S. Government reading "Permit to Re-enter the United

States" for those whose stay outside the U.S.A. exceeded

1 year; or

4.- Form I-797 together with Letter of Transportation issued

by U.S. authorities or U.S. embassies/consulates.

Additional Information:

- Alien Registration Receipt Card Form I-151 has been

replaced by Form I-551 and is no longer valid for travel.

Passenger is required to apply for a new I-551 (which

includes an application fee) and may experience delay in

admission.

- If the passport shows a Temporary Form I-551 Adit Stamp:

"processed for I-551 temporary evidence of lawful

admittance for permanent residence valid until receipt of

I-551 employment authorized", such a stamp is considered

to be Form I-551. For further information on I-551 Adit
