So I hear that I need to file this form in the near future. I live with my dad, my brother, and my mom. My fiancée will be joining us until we marry and find a new place to live which will most likely take 6 months or greater.

(1) So, do I need to show proof of assets over the 125% poverty line of 2 people? (myself and fiancée)

OR

(2) Since my dad is the one that pays all the bills, not me, I do not count my mom, dad, and brother, correct?

****$17,113 is the 2007 125% # ******

(3) Say when the time comes to file the the affidavit of support suppose I have assets (bank and stock) valued at $17,113 or higher, will I then not need a cosigner?

(4) I did not work for the year of 2005, How do I provide information or lack there of for this year in which I did not work?

(5) I have worked from August 2006 until August 2007 so far, however, I will not get my W2 tax documents until march or april of 2008. Can I get my tax documents for the year of 2007 early?

If your Father is your sponsor then everyone in the household has to be included, including you and your fiancee. You would need to see what the requirement is for five people in the household which I think is somewhere around 30,000

I am not sure what you mean by "if my father is my sponsor" , I am filing a I-129F for my fiancée whom lives in Mexico. What does my father have to do with sponsoring, or anything for that matter?? Please elaborate. ***************8

*********************Update: Oh, you mean that if my father is going to be the filer of the affidavit of support then it will be 125% of a household of 5. I understand that but I am going to be the filer of the I-134 affidavit of support.

If you're filing the I-134 for your fiance and intend to sponsor her, then you would count yourself and your fiance as the household. In order to qualify as a sponsor, you will need to make the minimum income that's required for your household. If you intend to use proof of assets, the requirement is that you need assets which are worth the minimum income multiplied by 5 ($17113 x 5 = $85565).

If you do not meet the minimum requirement with a combination of your assets and annual net income, then you will need another person who does meet the minimum requirements to sponsor your fiance.

For the next person to read this, Please answer this question:

A) I obviously don't have 85,000 dollars in the bank so I don't meet that criteria. Now, I live with my dad, he has a big house. He makes good money. If he is the co-signer I highly doubt he wants me to know how much money he makes every year and the exact amount of his net worth. If he cosigns does he need to file a separate I-134? For instance, the house I live in is worth way over 100,000 dollars. Can he just give me the papers on the house or does he have to locate the papers for each car he owns, all his bank information, stocks, mutual funds, and do a whole project that will invade his privacy, revealing all his assets to me. Thanks for the help

Young man! Your attitude stinks. Obviously you are not a qualified sponsor. You'll need to provide an I-134 but if your father is your joint sponsor, the one who qualifies, he only needs to disclose his income and provide the requested documentation to support his stated income. As long as the income alone is enough, he can simpy ignore all questions about his assets. In order to sponsor, he will need to disclose his full income on an I-134. If he won't do it, you'll need to find a sponsor who will. Time to cowboy up.

The visa process is no place for sissies.
