Not sure where to start, we were married in the first quarter of this year and our I-130 and I-129F are filed and we are in the process of waiting, they are both at the USCIS service center. (Just received NOA1's) Up until now we have been managing like everyone else but things have suddenly changed.

My wife was just diagnosed with a brain tumor that we are told will ultimately end her life if not surgically removed, the neurosurgeon here (US) who has reviewed the findings and says there is no time to waste. He says that the sooner we can remove it the better her prognosis.

She has a tourist visa now and could technically travel here now but he thought that there must be a way for her to expedite her immigrant visa allowing her to stay here under my care both financially and emotionally etc. I think the basis for his concern is that what happens if she is ultimately not able to return to work and/or support herself etc.) She has a son that is also dependant on her which means he needs to be here also.

Another issue we have is that to be added to my company insurance they require a copy of her visa stamp. Her tourist visa does not get stamped upon entry like a immigrant visa and does not appear to qualify. With her stamped immigrant visa adding her to my company insurance will not be a problem and it will cover pre-existing conditions.

This is my first attempt at finding a solution aside from scouring the USCIS and State Dept websites. I am waiting to hear what people here have to say in hopes of finding some direction to pursue.

There is an obvious medical need that the doctor will attest to and without the insurance couldn't this operation be considered a extreme financial burden.

I thought I read somewhere that these types of things could be taken into consideration.

What can we do in this situation? Can anybody offer advice? Anybody been in a similar situation?

There should be a fax number for the service center that your petition is at so you can fax an expedite request. You can also call your service center and explain the situation and they will tell you how to fax it aswell. I wish you both the best of luck with dealing with USCIS, but at least you have the travel visa for now.

USCIS does have a process to file an expedited visa request, but its far from a guarantee. There are instructions on how to expedite it on the USCIS website and what qualifies for an expedited requests, but it basically involves submitting as much compelling evidence of your request to expedite. Either way, good luck with everything and I wish you and your family the best

If she can travel here now, that is the first and foremost concern. So get her here. You are far more likely to get some consideration from your employer's insurance company for your wife than from the USCIS but how you pay for her medical care is of less concern than that she receive it very soon.

If she does go with the tourist visa entry, I would strongly caution you to avoid mention of her medical condition until after she is here.

Facts are cheap...knowing how to use them is precious...
