Man I am so happy I found this site, even though it was a little late in my Journey.

Here is the question for all you VJ GURU's

On the 864 it has household size.

A. Person on I-130 1

B. Me 1

C. My Husband 1

D. My daughter 1

Total 4 for one I-864 confused on the second I -864.

However now is the tricky part. I will have 2 I-864's in process for 2 Differnt Stepchildren. Do I add one to the D on one of the forms or not? It is not something that will affect the 125% rule by no means for me if you think that is the case.

Any help would be greatful. I have searched for Step kids on the forum and found no answers.

Why is it that the only one who can stop the crying is the one who started it in the first place?

4/6/2010 letter from NVC arrives to son dated 3/4/2010
5/4/10 received AOS and DS3032 via email
9/22/10 Interview BOG Passed
10/3/10 POE JFK all went well
11/11/10 GC Received smile.png

You have it right. As for your question, D will be filled out on both I-864's - so your total will always be 4.

Hi, my husband & I were going to go thru with the CR1/CR2 process as that is an Immigrant Visa that enables me to work when I get there. This route takes almost twice as long (stats right now) therefore he would have to apply for an I-130 for myself AND my son, one for each person therefore individual I-864's as well. We have changed our minds due to this process taking so long, just want to be together so now we will be applying for a K3 visa which is a Non-Immigrant Visa. I will have to apply for work authorization after I arrive in the US.

It all depends upon which Visa you will be applying for...only one I-864 if only one I-130 filed for your wife, kids would be listed on the I-130...

Family Based Immigration has an excellent link on their site regarding all that with step-kids...sure cleared it all up for us, unfortunately I can't post the link but it's under I-130 Petition - Alien Relative(USC) & I-129F Petition for Spouse (USC)! good luck to you!

Ok so even though I am doing 2 Differnt I-864 as they are not my dependents yet I will fill both of them out with 4 correct? I do not want any RFE's because I may have missed something. thanks

They aren't your dependents yet, however for the purpose of the I-864 they are dependents.

I would strongly suggest that if you are not comfortable with my answer that you call the National Visa Center at 603 334-0700 and following the prompts you will press 1 then 5 to speak with an operator.

Ok called NVC 9/20 talk about bright people, I just went ahead and placed a family of 5 on both.

You mean NVC suggested you put 5 for the total??

After an extended conversation I basically got no help, I called back and spoke to a different person, same thing. They could not really help me on how to fill out this particular portion. Both times it was like they were more confused then I was. So I added it up as 3 currently living in the house and the 2 I am applying for and sent it off. Hopefully no RFE. Still waiting on the fee bill and then we are off to the races :)

I didn't realize you had another person in the house, sounds like you made the right choice, let us know how it goes.
