Timeline

hi there. i am Diane and i am new here. this looks like a really good and informative bunch of people :yes: my man is from germany. he was here for 90 days and we married on friday and he left sunday to go home to germany :( i am heartbroken and wish the immigration laws were not so hard and long. but i guess you all feel that way to. i am happy there is a support group here for all of us traveling this journey together.

so my question is.. anyone know how long aprox. a k3 and k4 are taking? my husband has a 5 year old daughter from a previous marriage so she will hopefully be coming with him. i have heard that frankfort consulate goes quite quickly but i dont know if i believe anything in this process goes quickly!! and also does anyone know what step i do first. is it the filing of the I130 now?

File the I-130[CR-1/CR-2] but don't mention you may be filing for K3/K4. [i-129F]. That way you will have a better option to decide which visa you want.

CRs are MUCH better visas. Cheaper and easier also!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

File the I-130[CR-1/CR-2] but don't mention you may be filing for K3/K4. [i-129F]. That way you will have a better option to decide which visa you want.

That link is a bit out dated and incorrect in some statements.

Ex!

"After receiving the k3

visa, the spouse enters

on the K3 and is allowed

Wrong! Only thing correct is K3s are allowed to travel.

There are more plusses to the CR and negatives to the K3 since the fee increase.

K3 as a non immigrant has to adjust status to get GC or file EAD to get SS Card.

More paperwork, More money, interview ["Maybe"], stress and "possible" denial.[Not often but it happens].

Some peeps get them in a couple months but some take over a year+ to get the GC.

K3 pays $1010, K4 $600 to apply for AOS.

Has to pay a Designated Civil Surgeon [DCS] also and go thru more hassels sometime.

CRs are immigrant visas. They are cheaper but normally take a "bit" longer.

The BIG plus is CR/IRs get their GC and SS Card in the mail a short time after arrival in the US.

They can travel, work, open joint bank accounts, get drivers license etc WAY sooner than a K3.

No DCS or having tO do BiometricS ALSO.

The best way to do the spouse trip is to do as the LIFE ACT was intented.

File the I-130 [for CR/IR]and when you get the receipt notice file the I-129F [for K3/K4]. No cost now!

Take the K3/K4 interview and go to the US.

Don't adjust status and go back and take the CR interview ending up with a CR-1/IR visa and go back to the US and get the GC and SS card after you arrive again.

If it looks like the CR interview will be close to the K3 than just stay and take it.

May not be practical for some peeps to come and go back but it pays off in the long run.

You can probably pay for the plane ticket for what it cost you to adjust status now.
