QUOTE(My Le @ Apr 8 2006, 02:56 PM)

"I'm filing I-130. The petition was sent and was received in December, 2005 (NOA1), then the approving NOA2 came in yesterday, 4/7/2006. In between, I sent I-129F for K3 and it was received in March, 2006 (NOA 1/K3), NOA2/K3 not yet. So first, I think I should not wait for the K3; it's better for me to go ahead, take the IR1/CR1 path to be faster and it will gets easier for my wife to get her green card upon entrance, do you guys think so? Then if I do so, I need to let them know that I like to abandon the K3. Now my question is how and when to notify them. Will I call the Chicago office, where they are processing my K3, to ask for info about how to withdraw my K3 or should I wait for something else? Or what else should I do or anything else I should know?

The VJ I-130/K3 guide says that people should write to the consulate to tell them what they like when both approvals (K3 and IR1/CR1) reach them. But my case is different as none of them gets there yet. The I-130 is now being transferred to NVA, and the K3 is still being processed at its original service center (Chicago).

Anyone knows about this, please elaborate. Your help is greatly appreciated."

You should probably post this in the K-3 forum area.

(dalegg)

So I post it here.

Please help. It's urgent as I need to gather all needed info before going overseas this coming Thursday (just going back to Vietnam again to be with my wife as usual), and to do what I could do right away while I'm still here .

Thanks

At this point I would let both petitions continue. You could still get approval on the K-3. The K-3 goes through NVC rather quickly and is then forwarded to the embassy. The I-130 spends a long time at NVC. The K-3 could get you back together much faster. If you do come here on K-3 you have the option of returning to your country for the CR-1 interview or adjusting status in the US.

Could you please explain that with more details. For example, how the I-130 spends a long time at NVC, or how much longer,... if you could.

I had filed I-129F for fiance(e) [K1 Visa] before but failed so I already knew what was going on at the NVC stage. But for the I-130, I have had none experience.

Thanks.

The K-3 could be done at the NVC in a matter of days and then forwarded to the embassy. The I-130 could be weeks or even months at the NVC before it is sent to the embassy. Every case is different, but you have nothing to gain by cancelling your K-3. If your I-130 gets to the embassy first, the embassy will cancel the K-3 for you. You already paid for the K-3 so you might as well just keep processing both until you are together unless you would rather wait for the I-130 so you can get an immediate green card. Some people come to the US on K-3 and then return a few months later to complete the CR-1 interview and get a green card. That is what my husband plans to do. Other people come here and do an adjustment of status. And still others choose to wait for the CR-1 interview (this is usually people who could not afford the extra trip home or need to be able to look for work right away once they have moved to the US). You are the only one that knows what your situation is and the choice that is best for one person is not necessarily best for another. The good news is that you have time to make the choice, you do not have to make it now.

You might check out the following post. It could give you an estimate of how long people wait once a case number is assigned for the I-130 petition.
