:unsure: : how i supposed to know what tipe of visa i need, please help me i done whit all la documents here in the nvc, my housband call them,, and they said we have to go mexico for the nex procces, my case is close here and we dont, had any iidea what get it happens there, i thing we neeed a waiver and a hardship letter, but if, my waiver is aproved :thumbs: y the hardship letter es goood :dance: whath kind a visa should a need, or :unsure:

K1 is a fiance(e) visa

K3 is a spousal visa

It won't be a K1 visa. You haven't said which petitions were filed, but your visa will either be a CR1, IR1, or K3 visa. However, you do not need to make any kind of choice about that - they will process it and give you the right visa without you having to say which is the right one.

I am guessing you believe you'll need a hardship letter because you entered the US illegally. If it is possible, please try to get at least a consultation with a good immigration lawyer, because the wavier and hardship letter process can be really tricky. There is a forum here about waviers that you should look at too. Good luck! :)

US Immigration Timeline

24 Feb 2007 - Sent I-130 to London USCIS office (I'm the petitioner)

25 May 2007 - NOA2

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly
