Hi, and thank you for reading this.

Me and my husband (he's the US citizen) got married in July and are getting our papers together to start filing for a K-3. I am confused about the issue of domicile... for now, he lives in the US, but as I am 8 weeks pregnant, he will be moving here to be with me and the baby as soon as possible (most likely January). Can he file for me while he is abroad? Or, if he does the initial filing from the US and then moves abroad to be with me, will that be confusing with respect to changing the address on the forms and for correspondence?

He is only moving to foreign country on a temporary basis, he will still maintain his US Domicile address, keep getting mail to US address, keep a valid state ID, maintain US bank accounts, ect...

He does initial filing in the USA and then may spend time abroad while waiting for the visa to process.

Domicile is a bigger issue for DCF, and the CR-1 visa.

Also, can a doctor's certificate of pregnancy be used as a proof of a bona fide marriage or should we just go ahead and get the affidavits from friends and family?

For K-3 they are not too concerned about most of these things, they like evidence of communications, wedding pics, travel info. Since your husband plans on spending most of the time with you waiting for the visa, the travel info in his passport should be sufficient.

Bona fide marriage proof comes more into play later when lifting conditions from a conditional green-card.
