Here are some questions regarding the forms for the adjustment of status process for K-1:

On I- 485 part 3 letter A:

--the nonimmigrant visa #, where can this number on the visa be found? Is it the control number at the top, or the red number in the far bottom right corner?

--In what status did you first enter (ie. Student, visitor, etc.), what should a K-1 visa holder put here?

--Marital status, when he entered he was single, but now we are married, what do we put for this question?

On I-485 part 3 letter B:

--In the List family members section, should we include the American citizen (the new spouse)?

On I-765:

--I am applying for 1) permission to accept employment 2) replacement authorization 3) Renewal of authorization, my finance received automatic employment authorization when he entered New York JFK airport. For this question would we still put #1, or should we put #3 renewal?

-- #11 Applied before to USCIS for employment, since he received automatic authorization at JFK airport should he still put “no”?

--#14 Manner of status entered US, what is his status as a K1 visa holder?

--#15 Current Status, what status would he be in when we apply, AOS?

--#16 Eligibility Categories, what goes here?

And some final silly questions: How long can my husband work using the employment authorization from JFK airport, until his initial visa runs out in January? Once we file for AOS, does this change his status? If the process exceeds the expiration date of his visa does he have to go back to South Africa?

Thanks for your help on this!

His visa has already run out, its a one time visa. As soon as you enter the U.S. it is considered as expired, You now go by the date on the I-94 which runs out in January. Your husband can work for the duration of the I-94, once that expires then he is no longer authorized to work and will need to wait until his EAD has been approved. No your husband won't have to return to his home country.

Good Luck

Have you guys gotten married? I remember reading about the girlfriend in Africa and you were so heartbroken. :( He was going to travel to some friends before heading back home to South Africa I thought?

I hope you guys were able to work things out, and that his intentions are sincere.
