I sent my I-130 to Vermont via United Parcel Service (UPS) and it was delivered on August 27, 2007.

It is now more than three weeks later and I have not yet received the official notice from them nor have they cashed my check.

I know they say it can take up to four weeks but I have seen a number of people on various forums that received their notices far faster.

I have the I-129F ready to go but I can't send it without the notice from the USCIS.

Should I be concerned?

What, if anything, should I be doing now?

Hi,

have you checked if your check was cashed with them? Usually there is a long sequence of numbers (your case number with 3 letters and about 9 numbers)...

I-130 STAGE 1 : 533 days - 1 year 6 months (4/16/2007 to 9/22/2008)

Priority Date I-130 : 4/16/2007 ( 533 days , APPROVED 9/22/2008)
Transferred to local office based on "security checks" : 11/27/2007
wrote hundreds of letters - received letter from FBI Records Management Chief stating no security checks
local office interview : 2/21/2008 - brought my parents too (result : you will get approval within 2-3 weeks)

5/2/2008 - (lawsuit) Writ of Mandamus - OFFICIAL DATE (7/29/2008)
9/22/2008 - CALL AND EMAIL COPY OF APPROVAL NOTICE FROM LAWYER

Hi,

have you checked if your check was cashed with them? Usually there is a long sequence of numbers (your case number with 3 letters and about 9 numbers)...

As of September 14, 2007, USCIS has completed data entry and issued receipt notices for applications and petitions received on or before the dates indicated:

That means, since the last update, within ONE WEEK they've only gotten one day further ahead! We mailed our I-130 on Aug 7th, will be at least 2-3 more weeks at this rate! Something that normally takes approximately 10 days! What a mess!

Once they cash your check, print an image of front an back and use that as proof of filing. Under the new policy, you could have sent both petitions together. Make sure you send the I-129F directly to either Vermont.

It would be nice if the mods would put up a sticky thread about the simultaneous filing of the I-130 and I-129F. I think a lot of people are missing out on a significant time savings because they don't know about this.

It's about time alright. I can't count the number of times I've posted that link.

For clarity though, the link does not refer to filing the petitions together, just to filing them directly with the appropriate service center. Because only proof of filing the I-130 is required to file the I-129F, logic tells us the proof can be the I-130 petition and check in the same envelope. Several have done so successfully, so we know it's ok.

i cant file the I-129f, i have to wait until they cash my check now, is that right?

Hello, I did file them together, however I am still waiting for either the check to be cashed or a notice in the mail. As of tonight neither has been done, but according to what I have read in here, this week or beggining of next week should be cashing checks around my date. At least I hope so :thumbs:

I also sent my I-130 out in August and they received it on Aug. 23 . I didn't know that I can send both I-130 and I-129 in at the same time, but oh well , now I am just waiting for NOA , I have I-129 ready and I can mail it in as soon as I get the NOA which will probably take a while since they are taking forever to process everything.

Maybe in next couple of weeks I'll be getting some helpfull info.

I sent ours Aug. 8 and the check was cashed 9-11-07 and entered 9-12-07.

That's 35 or 36 days. I saw the online copy of the back of my check- but still have not received the NOA1 notice. But that's per typical.

Also, as pushbrk said (and I put the link in my sig line too) I sent both our I-129F and our I-130 to CSC directly. The website says they have started our I-130 and says nothing about our I-129F.

2-2-07 Sent I-129F to NSC

2-6-07 NSC received USPS mail, NSC then to CSC

2-15-07 NOA1 -file received

2-16-07 check cashed

2-23-07 touched

5-4-07 NOA2 approval -email

5-13-07 sent cancellation request letter

6-7-07 we're going to retry with a K-3

8-6-07 married in Thailand (dual language, dual representation prenuptial)

8-7-07 sent K3 from Bangkok

9-10-07 I-130 NOA1, (received at CSC 8-9-07)
