Welcome to VJ! When you say first packet, do you mean the very first thing you send to the service center in the US with the I-129f form? Nope, the sponsor stuff gets dealt with at the embassy

:guides:

The guides up at the top of the page are a great resource. I followed the AOS one step by step (had already done most of the K-1 stuff by the time I found VJ) and haven't had any problems thus far.

Financial information is not included in the original I-129F petition.

You will submit the I-134 at the time of your fiance's visa. This is when the co-sponsor will first become relevant.

Once your fiance is here and you are ready to adjust his status, your co-sponsor will have to fill out another form - and this one is legally binding.

Best of luck to you.

The first one is legally binding too, but only for a 90 day period :) The one for the adjustment of status (AOS) follows you around for years!

I believe the I-134 states it is binding for three years. The level at which the beneficiary must be maintained is not specific on the I-134 but it does state that the person cannot become a public charge. The Moroccan consulate rarely keeps the I-134 and sometimes doesn't even look at it, so in the cases where it isn't kept, it cannot be enforced.

There is a documented case of a sponsor being sued under the outlines of the I-864 and having to pay the beneficiary a settlement to maintain them at 125% poverty level (if I recall, it was around 9,000). It is something to think about when considering asking someone to be a co-sponsor.

Oops, my bad for not reading it  That is really really odd that the Moroccan consulate doesn't keep the I-134. I would think it would need to be included in the stuff kept in the immigration file here in the US. Who would they sue if the immigrant started using US services/handouts during the I-134 support period?

One thing to keep in mind with Morocco is that, unlike some countries, there's no "Packet 3" or "Packet 4." They just send your fiance one package with all the forms they'll need to fill out, as well as their interview date. So all forms, including the I-134, are brought on the day of the interview. The only thing you have to do ahead of time is get the medical exam, which the doctor sends in separately prior to the interview.

Hey there and welcome!!

Im just aggreeing with the others...the I-134 gets sent to your fiance right before their interview. My husband wasnt even asked for it or about it at his interview, but I have read that others were asked to show it and were asked questions about it....its hard to really know what they will ask for because it changes depending on the CO apparently. Its better to be safe than sorry...and have your fiance have it with them during the interveiw, and also review it before the interview.

good luck!! send off that I-129F...get it rolling!!
