hi everyone,

i have a question. if a k3 visa has been granted and the cr1 case is already in the embassy with a set interview date, will the k3 visa holder be able to go to the US and then jsut come back for her cr-1 interview? i know the practical advice would be to just wait for the cr-1 interview and visa but there is a very impt event that my wife would like to attend but she wont be able to if she waits for the cr-1 visa.

is there any potential negative consequence if she goes through with this?

also for those who are applying for the cr/ir visa for their spouse in the philippines, i spoke to 3 different NVC reps on Sept. 14 and all told me the same info:

cut off for processing interviews for the following month is on the 2nd week of the previous month and embassy in manila conducts interviews throughout the month. unfortunately for us, our case was completed late sept. 14th and thus we weren't able to secure an Oct. interview slot=(. hence my initial question.

If both K-3 and CR-1 are in process, and the CR-1 looks like it will come up for an interview many either postpone the K-3 until the CR-1 arrives at the consulate, so that the consulate will just intervew for the CR-1, or you can interview for the K-3, and just wait in the foreign country for the CR-1 interview.

The CR-1 is much less expensive to get than to adjust status in the USA. (CR-1 $390, I-485 (Adjust status) $1010)

Yes you can request the K-3 be skipped for the CR-1.

She can come back for the CR1 interview if she wants to. The only difference between the K3 from CR1 is the AOS process which will cost you over $1K. The interview date gap between the 2 will just be between 1 1/2 - 2 months wait, and the plane ticket you will be spending just for the interview will be pretty much the AOS already, so that alone will not be practical.

Yeap that is true. Don't forget the upcoming holidays that will delay further the whole process. Times like this in the Philippines is pretty hectic, so we must expect delays and be more patient. Thanks for the info :crying:

it appears that her interview date for the k3 will be much earlier than the cr1 interview date as I had talked to reps saying that they would be able to tell us by end of the week when her k3 interview date is while her cr1 interview date wont be known for sure until 1st week of october.

This was the original intent of the K-3 when the Life Act Law was passed creating the K-3. The intent was so that the immigrant waiting for the IR-1 or CR-1 visa could travel to the USA to be with spouse while waiting for the immigrant visa, and then travel back to home country to interview for the immigrant visa.

we are aware of the cost and she will be able to get discounted airfare so there will be no issue regarding that. i just wanted to get info as to whether:

1) they will still honor/process her cr1 interview even though it was set before she would hypothetically leave the country on a k3 visa and

2) be able to go back with no negative consequences/record.

as for the upcoming holidays in the phils., you are correct--the timing is bad esp. since nov. 1 is on a thursday. had it been a wed. like last yr, the next 2 days would not be declared non-working days. how i wish idiscovered james' shortcuts much earlier(argh!)

also, how can i tweak my profile it shows both the k3 and cr1 timeline? i can onyl figure out how to show 1 timeline.

We have almost the same case with ur K3 and CR1..

Do you have your CR1 interview date already? and about ur K3 when will be schedule interview date? Want to know what happen to ur case for sure this will help if what should i do with mine

This is what im planning to do:

A. I will request a CR1 visa in my K3 interview on Oct. 05 to the CO.

or

B. I will call USEM after visa completed in NVC and ask them if i can have a CR1 interview instead in replace to my K3 interview on Oct. 5.. If this is possible even if they only have the electronic copy of my case.. :unsure:

Hoping and praying that our case will be completed on Sept 24 in NVC. :innocent:
