If your husband applied for an EAD based on a pending AOS, that will be denied if/when the I-485 is denied.

Your husband can apply for EAD based on K3 status though.

2007-04-16: I-485 and I-765 sent to Chicago (My AOS/EAD checklist)

2007-04-17: Received at Chicago

2007-04-23: NOA1 date (both)

2007-05-10: Biometrics appointment (both - Biometrics review)

2007-06-05: AOS interview letter date

2007-06-13: AOS interview letter received in mail

2007-07-03: EAD card production ordered

2007-07-07: EAD card received! (yay!)

2007-08-23: AOS interview (Documents / Interview review)

2007-08-23: Green card production ordered!!!

2007-08-24: Welcome notice mailed!

2007-08-27: Green card production ordered again... ?

2007-08-28: Welcome notice received!

2007-09-01: Green card received!

Done with USCIS until May 23, 2009!

well both got mailed in together.. but it was not filed on a Pending AOS

Immigration sent me a letter telling me to Re Send the payment with a additional $30 for the cancelled check - I got that in the mail Yesterday...

Tomorrow he has his biometric appointment for the EAD AND the AOS.. he never received the NOA for the AOS.. so I surprised that he got the Biometric WITH AOS too

You're right, you did say you haven't heard of it happening. My bad.

I have not really watched (in a while) what type of visas those approved without interviews had when they entered the country. However, from my own personal experience I do know that it's not limited to just K1s.

Anyway, I think what matter is that the OP should consider sending in that written request to withdraw the I-864 that she signed as that's the only way she can be sure the AOS will not be approved.

True that other types of visas CAN be approved without interviews - but in my travails (heh) you are the only non-K1 I have seen, so it's pretty rare.

Jenn, I don't think that's entirely true. There is a possibility that a K3 can get transferred to CSC.

If you successfully stopped payment on the check, you're probably covered but the safe bet is to send a notarized letter withdrawing the I-864. Include the AOS case number on the biometrics appointment notice and send it Certified mail, to the address from which the biometrics notice was mailed.

This covers all bases, including the possiblility of transfer to CSC after biometrics and AOS approval without interview. Yes, he can go to the biometrics appointment without you. Unless you are needed for translation, you might be waiting outside anyway.

It should also clear you of any culpability of writing a 'bad' check

If they asked for a fee for the bad check you may want to see if you have to clear up that charge.
