me the wife being the sponsor....

what happens??? Does he get denied?

and what about the biometerics appt? does the wife/ sponsor have to be there??

and i called before and they wouldnt talk to me cause I was not the the person applying... So how can i cancel my affidavit.. if they wont talk to me???

he has his biometrics tomorrow.. I want him to get hes EAD only.. not the AOS..

If the sponsor doesn't show up at the interview, uh yeah, he'd be denied. And would probably be stripped of the EAD as well.

They don't care if you show up at biometrics or not.

I do not want to jump to any conclusions (i have already in my head) but if you do not want to go through AOS for whatever reason and want to cancel your sponsorship, you need to do it completely.

No EAD, no AOS. nada, nothing

The EAD is granted for a normal AOS because the person is pending a status change that grants him the ability to work.

I think dee's husband is on a K-3, meaning that he could apply for an EAD without also applying for AOS (and needing no I-864.) He has two years on the K-3, so he'd be able to work until then.

If you want to withdraw the I-864, you might be best writing a letter. The call center line isn't going to be of much help.

Can't you call USCIS and ask them how to cancel the affidavit of support? I call on my husbands AOS and they give me info on it and talk about the case, even though it is his.

You don't have to go to his biometrics. But if you don't show up at his interview, he will be denied. It's almost certain about the denial, or perhaps he can make up some excuse to get another interview date. But definitely no approval without the wife being there.

The biometrics appointment, your husband will be having his fingerprints done, i went to my husband's appointment cuz i wanted to not that i HAD too. The AOS interview, YES, you must attend cuz u r the wife. this adjustment of status is based on your marriage.

A lot of people have had issues with not being able to get information from the USCIS line because it's not their application, it is their spouse's.

As far as making up an excuse to get another interview date, that could just as easily result in denial as we've witnessed on VJ before.

I don't know if an infopass would be much more useful because again, not her case. I agree with whoever said that writing the letter is probably the best way.

Well if he pays for it and you dont show up..guess what??he doesnt get hisa visa. This is a marriage based petition for adjustment of status. You the wife MUST be present at the interview, it will state that in the appointment letter.

If you stopped payment, it will get rejected and there won't BE an interview. USCIS doesn't do anything until they have their money.

First take all the papers with you, so he doesn't know where to mail it even if he gets the slick idea himself.

Second, do mail a certified letter that you are withdrawing from AOS.

Actually, I'd call an attorney for maybe like a free consultation to ask to make sure you are covered. There are some that do pro bono work and may at least offer you this bit of advice.

Jenn, I don't think that's entirely true. There is a possibility that a K3 can get transferred to CSC.

It would be best for the OP to send a formal letter withdrawing the I-864 to the AOS. Without the I-864, the AOS application will not be processed.

I just said that I haven't heard of it happening, which is true, not that it was impossible. Have you heard of a K3 that's been approved without interview?
