We're still a long way from tax season, but does anyone know if I can claim my wife and son (both in Canada still and, at this point, CDN citizens only) on my taxes next year. I think I'll be able to do it for my son quite easily as soon as we apply for his dual citizenship and get his SS number, but I'm thinking it will be harder to claim my wife...anyone have any ideas or experience with this?

Timeline

7/11/2007 - I-130 NO1A Hard Copy

8/13/2007 - Son Drayson born in Sudbury, Ontario.

9/6/2007 - I-129F NO1

10/15/2007 - Trip to Toronto for Dray's Consular Birth Abroad, SS application, and US passport

3/18/2008 - NOA2 for both I-129 and I-130!! No touches or email notifications at all!

4/2/2008 - estimated that NVC received

4/9/2008 - estimated that K-3 was sent from NVC to USEMontreal

4/16/2008 - Received hardcopy from NVC

4/16/2008 - Packet 3 Received

4/24/2008 - Packet 3 Sent to USEMontreal

7/14/2008 Interview in Montreal!!!!

7/17/2008 Visa received

7/18/2008 POE Sault Ste Marie Michigan

8/21/2008 moving day...back to Anchorage, Alaska!

4/20/2009 AOS granted, 10 year Green Card arrives, Social Security # given :)

Yep you can!

File a W7 with your next tax return and your wife will get a ITIN . I did it. They gave one to my wife but didn't allow my stepchilds for some reason.

The IRS W7 form can be filled out and sent via computer. Saved also!

PS ! I filed a Joint return. Mainly for more evidence of a bonafide married.

I always tell people to get an acocuntant. Ours gets us thousands more back a year that than when we do it ourselves.

Entered US on TN work permit

2003 through 2007

Renewed TN Annually

March 2007

Eloped in Central Park on vernal equinox, then honeymooned in Paris.

April 2007

Early April: Renewed TN on return from Paris

June 2007

Sent in AOS/I-130/EAD package

July 2007

July 14: DOA1 - delay in processing because CIS told me to send package to the wrong center.

Late July: Received Biometrics notice

Aug 2007:

Aug 2: Biometrics Appointment

Aug 8: Received RFE for missing medical forms which CIS told me originally not to send in!!

Aug 16: Medical Forms Received at CIS

Aug 24: Received e-notice that EAD card was ordered (No more TN! yay!)

Aug 30: Last day of work on TN. Laid off from job. :(

September 2007

September 5: Received Card! Just in time. Started part-time grad school today.

October 2007

Oct 2: Received Interview Notice: Whoo-hoooo!

November 27 2007

Had GC interview, which went smooth as silk. Received passport stamp, too.

I would recommend getting an accountant to help you with your taxes this year. Since this is our first year of marriage, and I don't know what I'll need to file and if I can claim my lil Canuck, I figure (no pun intended) that an accountant will be very helpful.

I've always done my own taxes and didn't find adding my husband difficult at all. He already had a SSN so didn't have to get him an ITN but understand that that is pretty simple. If the non-USC makes less than $80,000 a year it is a very simple form (2555EZ) to exempt all of their income. You add it into line 7 then subtract it around line 32-it's as easy as claiming education credits (sorry thats the only other thing that I've ever had to claim) If you make more than $80K maybe you should hire an accountant, you can afford it.

10/4/05 fly back to US to "finish up Master's" lose mind and switch to PhD

Damn it back to the US process

3/something/2005 finally get NOA2, no idea why it took so long

4/15/07 get case approval from NVC

8/9/07 Montreal here we come

10/14/07 hubby activated his visa
