:help: Hey guys,

I got married a couple of months ago and started collecting all the papers for filing I-130. The problem is that my wife is not qualified to be my sponsor because she made less than $10000 for '06 that's why we found a co-sponsor who made something between $16000 and $17000 for '06 and $10000 for '05, he is not married which means no other members in his household. I do not know how much is the minimum for him to be a co-sponsor in our case.

And in case I file with him(my co-sponsor) and he is not approved what's gonna happen!? I badly need to file and get my employment authorization. I have H-2b case pending in USCIS (which has been taking for more than 2 months) and I am still not allowed to work, my previous h-2b expired a month ago I am going crazy! :help: Thanks in advance

Since the co-sponsor doesn't have any other dependents it is only two. For two persons it is $17113. Just subtract the amount the co-sponsor earned from $17113. Whatever comes from there, multiply with three (since USC is bringing the spouse it is only 3 times for assets). That's the amount the co-sponsor needs to have in assets. Here is an example

say the co-sponsor made $16000 in 2006.

$17113 - $16000 = $1113

multiply $1113 by 3 = $3339.

You can put the $3339 or more in bank account or from any other asset.

Then you are good as far as I know.

The sponsor must qualify so it must be the sponsor's bank account. Theoretically, this will work. However, a little over a thousand bucks in a savings account could be wiped out easily and any adjudicator knows that. I would advise you to find a sponsor with a higher income if possible. When the sponsor isn't the spouse of fiance, and lives in poverty themselves, it does little to convince an adjudicator that the intending immigrant will not become a public charge. That's what you're trying to accomplish, to convince a reasonable person the intending immigrant has adequate means of support.

I beleive for the co-sponsor it would have to be five times the difference. it would be 3 times for the spouse of the immigrant.

another thing to consider, is the co-sponsors current annual income for 2007 above the minimum? then a letter from his employer and copies of 6 months paycheck could show he mets the requirement.

Both important points. If the spouse or fiance can meet the requirement by annualizing their current income and provide adequate supporting documentation, that is far superior to any use of a joint sponsor. Yes, the sponsor must be the spouse for three to one to apply. Otherwise it's five to one.

Doesn't the co sponsor have to qualify to support 3 people?

Himself and the hubby and wife?

The co-sponsor only has to have income to support him/herself + their own household (in this case none, because he is no married) and the beneficiary immigrant. A co-sponsor does not need to support the USC.
