I have heard that they like to see pictures where you are kissing.....that apparently helps more than regular photos....

It is also the norm if someone has been previously married to show evidence that they divorced or else they are not legally allowed to get married again.

Good luck none the less!

The USC needs to find another sponsor or be able to show assets (don't know how much they should amount to) otherwise the embassy will not issue the visa.

I hope you can find help soon

They want evidence of a bona fide relationship. This does not specifically mean evidence you got married, so other pictures besides those taken at the wedding are very important. They show a bona fide ongoing relationship. If your only pictures are at a wedding, that is not as helpful as pictures together at different times in different places.

Evidence of ongoing communication is very helpful. If you can provide a couple emails for each month of your relationship, that's good. Of course if you only have 5 or 10 then that's the best you can do.

I take it you provided a photocopy of the divorce decree. They shouldn't keep but may want to see an original. The original should show the court authority's signature and seal.

You will need an additional sponsor or show assets. There is no getting around that.

There a legal rules the embassy MUST make sure you fulfill or they can not issue the visa.

These are laws in america, and there is no way around them. So, if you want visa, you must find a way to meet the law.

1) You must prove you will not become a welfare burden in america. To achieve this you must show a good job record with sufficient income. If you can not show this, then you must have a co-sponsor sign who can show good job and sufficient income.

2) You both must be able to be legally married, and you can only be married to one person. If you have never been married, you must present a single status affidavit, if you have been divorced, you must present the divorce decree proving you are single. Then since your in the I-130 forum I presume you are married to the USC, so a marriage document for you two people would be needed. All these documents must be translated to english if not in english originally, and must be notorized as a good translation.

3) Your marriage can not be one that was done only for the purpose of the non-USC to get a visa. How do you "prove" you are really in love, and not trying to get a fraudulent visa?

a) How many times do you talk to each other via email, telephone, chat.. whatever?

B) Do you do anything together? How many times have you visited each other.

c) When in the same country do you live together?

d) Do you go anywhere together and enjoy things together, are there pictures of you.

e) Do you have children together. This pretty much guarantees you have a relationship :)

f) Do you share your money with each other, all of it, not just a small amount?

Those are the law, how you meet the law is your choice.

Now I discuss #3

For #3 it is difficult to list the things that "prove" a relationship but this is intentional. If you could make a list then the people who wish to cheat would just follow the sheet.

For a "real" relationship these things I listed come naturally.

My wife and I talk for 1-2 hours EVERY DAY.

We have over 1,000 emails sent between us.

We have cards and letters hand written and mailed to each other.

We have purchased things together in both China and America.

We have photos of us on tourism.

We have photos of us with her colleagues from work.

We have photos of us with her family.

LOL .. The workers in the market in her home town KNOW me because I shop there with her so often.

No, we do not live in the same country, we live 13,000 km apart. So don't tell me how difficult it is to get together.

This isn't things we did for the visa people, these are things we do because we love each other and hate being apart.

Many people worry about the "proof of relationship", but I think if you really are in love with each other, #3 is the easy thing to do.

Perfect answer to number 3. We do it because of our love for one another and the government does it to protect innocent loving couples; and to catch the few who will lie, cheat and steal their way into this great county for whatever reason. I ask where else in the world do millions try to legally and illegally every year? Go figure! It happened long before terrorist and it will happen long after

My wife and I are very much in love, so I don't want to throw any cold water, but what needs to be proved is that the relationship is a bona fide. In love is a possible element but not a required one. Love is not a requirement for a fiance or spouse visa. A bona fide ongoing relationship is. In this case bona fide means there's a real relationship outside any desire for immigration to the US.

Certainly, people in love, have an easier time showing evidence of bona fides.
