Some questions regarding I-485 & I-864...

Hi everyone. I'm in the process of doing applying AOS for my wife. I just have some very simple questions:

Regarding the I-485:

Q1. On Part 3) Where it says "Were you inspected by an immigration officer?" My wife was not "physically" inspected by an immigration officer. As far as I know, she just stood at the POE, they took fingerprints and her picture and and she gave her documents (the packet that she took with her) to the officer waiting after she waited in line... would this be a yes or no? She didn't have to go into a room or anything, she just stood in line with a lot of other international arrivals.

Regarding the I-864:

Q2. I was wondering to use I-864 and a I-864A or just 2 I-864s? For the I-134, I had a co-sponsor which was my father. Both my father (co-sponsor) and I (main) filled out and sent it in and our visa interview was fine, so we had used two I-134's with supporting evidence. I am also listed as dependent (which makes sense) on my father's forms.

Q3. On Part 5) c. It says, "If you are currently married, enter "1" for your spouse"... I noticed on the EXAMPLE form, it says 0, but I (sponsor) am married to my wife (immigrant), do I enter 1? And add up total to 3 if no other dependents? Or is there something else?

Q4. On Question 25 of the form: Since I have only one year of tax returns (W2/1040), can I just leave out other blank for the 2 years? I only started working as of last year.

Other Questions:

Q5. I had a question about the marriage certificate. On the VJ instructions, it says to send in a certified marriage certificate, but I only have certified copies of marriage LICENSE. When I went to my nearest marriage county building, they said the certificate is only for decorate use, there is no official use of anything. When I had tried to get another copy of marriage certificate, they took my old one and gave me a new one which had nothing written on it. So I just took back my original certificate and left it at that. I wasn't sure to send in the original certificate + another certificated copy of my marriage LICENSE?

Q6. When writing the cover page for AOS packet, should I or my wife write it? Since the I-485 & G-325 are my wife's and signed by her. In the I-129F cover letter, it was me, the main petitioner that wrote/explained & signed it. But I am not sure whether to do the same.

Q7. We will provide a full copy of my wife's passport copy. This should include her K-1 visa already in it. Do we need to have another copy of it as indicated by the VJ instructions like two copies: copy of FULL passport w/ Visa stamp & another of just a visa stamp: "4. Copy of the non US Citizen Spouses Passport (biographical page as well as entry stamps). 4a. Copy of the non US Citizen Spouses K-1 or K-3 Visa from Passport"

Q8. Sorry, not a visa Q, but more of a technical Question.. On Part 4 of I-485, I noticed on this page, my Adobe Reader Pro v8.1 cuts off a line that reads "provided I have not yet reached age 26?" I noted that upon opening the I-485 file, my Adobe says "invalid barcode value: formi-485rev 07-30-07 is an invalid value for barcodes of type code3of9" When I print it, the "provided I have not yet reached age 26" is cut off so it prints weird.

I hope these questions aren't too confusing and will help others who have the same. Thanks everyone for all the support!

The answer is yes. "Inspected" means she entered at a POE, that's all. If you answer "no", that would mean she jumped over the fence without any inspection and thus entered illegally.

Does your father live with you? If yes, he should fill out an I-864A. If not, - I-864. And even if he lives with you, he can still submit a separate I-864.

You enter "1" for the immigrant, which is your spouse, so it will be "zero" for the spouse, since you're not supposed to count anyone twice.

They only need one tax year, so yes, you can leave it blank.

I didn't even send a cover letter - they can figure out what you're applying for and what's in your package. But it really doesn't matter who writes the cover letter - either of you can write it, and you both can sign it.

I can't answer the other two questions, sorry.

Thank you for the quick reply! Sorry I had edited my post with another additional Question. Regarding the I-864, my father does live with me. I wasn't sure which was the best route to go: either I-864 + I-864A or 2 I-864's. Thank you again!

I was wondering the same for the affidavit but we sent two separate ones(my husband's mom is co-sponsoring us).

Regarding the barcode it ddid the same to us and I even asked on VJ whether someone else has experienced that, they said it has happened before and it was ok with them.So we sent the papers like this.I hope everything will go ok.

But we will have to wait for NOA for a month probably:(

Ah I see. Does anything know about the marriage license/cert Q? I am still unsure of what to send. I wasn't sure to send in the original certificate + another certificated copy of my marriage license? Or just a certified copy of the marriage license? And does the I-134 evidence work with the I-864? I will send in the same evidence types: bank check, payment stubs, etc. supporting documents but now dated later. Thanks again.
