Should I abandon my I-130 sinc I-129 seems to be going quicker?

Timeline

I just recieved my IV bill. I discovered the waiting time for an interview for an I-130 out of Montreal could take up to 6 months because they are so shortstaffed in the embassy in Montreal.

My I -129 is on it's way to Vancouver and they're waiting time seems to be a few days for an interview. In light of this should I abondon the I-130 process is there any benefit in letting it continue?

08/12/2006 - Married in Canada

08/23/2006 - Filed I-130

08/29/2006 - NOA for I-130

02/24/2007 - Filed I-129

03/05/2007 - NOA for I-129

03/15/2007 - Transfer Notice for I-129 to VSC for processing

05/07/2007 - Transfer Notice for I-130 to CSC for processing

05/15/2007 - Receipt Notice for I-130 now pending at CSC

05/30/2007 - Transfer Notice for I-129 to CSC for processing

06/08/2007 - Receipt Notice for I-129 now pending at CSC

07/13/2007 - I-130 Approved

Based on your time line, it seems like you filed a CR-1 not a K-3 petition? At any rate, a CR-1 & K-3 can be filed simultaneously? If one visa goes through before the other, you would simply forfeit the fee.

Basically what I want to know is... Is there any point in me paying this IV fee bill I just got for my I-130 when it seems my wife will most likely get her interview done in Vancouver through the I-129.

If you can wait you won't regret going with the CR-1 as adjusting status for a K3 can be a pain in the butte.

Not only cost a lot now for K visas but not having a SSN limits what the bene can do when they get here.

Just a couple! No work, No drivers license.

Also there is a possibility of the AOS being denied. Doesn't happen much but it does happen.

CRs get the GC and SS Card in the mail shortly after arrival and don't have to bother with USCIS for 21 months when they have to apply to remove conditions.

Some Ks adjusting are still waiting for GCs after a year.

Some get them in a couple months.

It's a ####### shoot!

We went with the K3 and we went thru hello adjusting status.

Regret it now.

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

You got it! That's the way the K3 were originally created to be used under the LIFE ACT.

I would have done so but it wasn't that easy to have my wife and daughter fly back to the Philippines and do the CR interviews.

I would have done so but it wasn't that easy to have my wife and daughter fly back to the Philippines and do the CR interviews.

Since you're reasonably close to Montreal, I would seriously consider skipping the AOS process and just get the K3 and follow it up with the CR1 interview in Montreal later.

You cannot abandon the I-130 application! Your K3 is linked to it. Abandoning the I 130 also means abandoning the K3.

The first step for both K3 and CR1 is the I-130. If you want to move to the US faster and wait for CR1 processing while here in the US, then you apply for K3 using the I-129. You must also continue with the CR1 process meanwhile!

This is only partly true but mostly not. Yes, married people must file the I-130 and it must be approved before they can have a green card, by either visa process. However, you can "abandon" the I-130 by not responding to NVC. You do not have to continue with the CR1 process after the I-130 is approved. In fact, unless you specifically request Consular service, the current policy is that USCIS processes both petitions together, then holds the I-130 for the AOS process, so CR1 processing ceases upon approval of the I-130 and I-129.

If no I-129F is filed, the CR1 process continues.

The OP's case is unique in that the I-130 was filed before the new policy was put in place and the I-129F was filed several months later. This resulted in both being approved separately and the I-130 not being held.
