Hi Everyone,

I am a bit confussed (yes, once again......lol). Am I correct in saying this;

Your Fiance comes to USA, you get married, then you put in your AOS, while you are waiting for aprrovals, etc, he/she auto matically gets a "Temp" GC. Then the papers you filed get processed, and, you receive an NOA, then Bio, Then interview. Once interview, if approved, then they send you a "Permenant GC"?? I only asked because I was reading a Time Line today, and noticed that the person's time from AOS until interview was only a few months, and then I remember reading that you need to go to interview approx 1yr and 9 months. So I was wondering if this was the way it works or if the person just made a mistake on her time line or if it is possible to get your Perm GC, before the 1yr and 9 months. Thank for your help

You get a conditional GC if you've been married for less than 2 years at the time our AOS is approved. Then, 1 year and 9 months after it's approved, you need to remove conditions on your GC, and that's when you get a 10-year GC.

It's hard to say how long the wait between the AOS submission and approval may be - it can be a few months, it can be a few years, each case is individual. But the conditional GC is not something you get while waiting for your AOS to be approved - you get it only after it's approved. While you're waiting for an approval, you can get an EAD (Employment Authorization Document) that lets you work while you're waiting for a green card, and an AP (Advance Parole) that lets you travel.

If, however, at the time your AOS is approved your marriage is more than 2 years old, you will skip the whole conditional thing altogether and get a 10-year GC right away.

The amount of time it takes to process the application varies from case to case. I have seen people have their GC in hand in about 2-3 months, and for some people it takes a few years. No way to know for sure, and I'm not sure what all they look at that makes the time vary so much. As far as getting an automatic "temporary" GC after you send in the papers, I don't think that happens - they just don't allow you to leave the US whil your case is being processed, unless you file for what is called "advance parole." And you can also apply for the work permit while you are waiting for the GC, which is a good thing. Hope that helps! Good luck!

12-28-2005 - Ede comes back to the US! (F-1)

07-06-2007 - Went back to civ. surg. w/ TB clearance...not good enough. Can't have the physical yet.

07-13-2007 - Chest x-ray being checked out by TB doc...still no exam.

07-13-2007 - AOS packet ready to mail...except for I-693.

07-24-2007 - Still no exam, but at least they let us set up the appt...

07-27-2007 - Med. Exam DONE! Overnight-mailed AOS application to Chicago!! :D

07-28-2007 - USCIS signed for delivery of package

08-24-2007 - NOA1 Date1, although it was rejected. See next line.

09-04-2007 - AOS Rejected - improper fee, even though it was postmarked before the 30th

09-05-2007 - Sent back entire package with new cover letter explaining improper rejection

09-23-2007 - AOS package rejected again! E-mailed Congressman

10-05-2007 - Went to Congressman's office - left packet there so be re-sent

10-19-2007 - NOA1 Received -FINALLY! Not rejected! :D

11-02-2007 - Biometrics appointment at Waukegan Office

02-05-2008 - Interview in Chicago -approved! :D

So is the interview for the Temp GC or the Perm GC, cause I always thought it was for the Perm.

After you get your visa (k-1 or whatever it was) and file for your GC, there should only be one interview, unless you need to have one for the work permit. So it doesn't matter if it is for the 2 year GC (which is what you will get if you were married for 2 or less years before your application was filed) or the 10 year GC, there is still only the one interview.

Greencard is greencard whether it be conditional or not. There is usually only one interview. However some people who apply to remove the conditions on their greencard after 2 years have had to have an interview.

It is also misleading to say "temp" greencard as I have noticed alot lately that people seem to think it is as stated "temporary". The conditional greencard gives all of the rights and obligations as the 10 year card but only that the basis of the conditional card being a marriage less than 2 years at the time of approval.

There is no interview for EAD.

If I'm reading what you asked correctly... the answer to the first part of your question is "No, while you're waiting for approval you don't get a 'Temp' GC. In most cases, once you've been approved (Biometrics, Interview - if one is conducted - etc), you'll get a Conditional GC (as others have said).

After all that - a person would apply to Lift Conditions, for a 2-year Conditional GC you would do this no sooner than 90-days before it expires (most people remember this as 1 year and 9 months because that's about how soon you can file to lift condtions..)
