i dont' have tax returns, what else will work

i dont' have any tax returns. i've been working on a cash basis for many years, and um, don't seem to have any tax retruns or records of income. i do have (or can get) my bank records, showing deposits over the last few years, but other than that, i have no proof of my income.

what else will work?

i have family that has good income and assets, but i am leery of getting them involved. but if i have to, i have to. i don't want to wake a sleeping dragon by trying to re-establish my tax return status and introduce another delay and expense to my life process. i also don't want to do anything that will "red flag" my application and that wil hold up the process. i just want to get married and make the immigration happen.

i'm a bit confused about the options, tho i've been reading thru the site. too much information, but not the "here's what you do" answer i need. thanks!

what does getting paid in cash got to do with not filing a tax return...??

It's against the law not to file a return if you earned over a certain minimum for your situation.

I dont think you want to be filing a petition.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

I am sorry for you, but desert fox is right. If you had enough income to file and did not, you have broken the law.

Just breaking the law is enough to deny the visa. They have something about moral terpitude .. or something like that.

Assuming you have broken the law.. not saying you did of course:

If you file showing income, but have no tax returns filed you are basically handing yourself over to the IRS.

If you file and say you have no income, then you need a family member to sign that they will support your fiancee/wife for the next 10 years .. even if you divorce, even if she divorces you and marries some one else.

A VERY big favor to ask.

You have messed yourself up by not following the laws, and I am afraid you will now pay the price.

I think one option you have is to hire a very good lawyer to get yourself out of the mess you have created. When I went to the embassy the interviewer wanted to see my tax returns. From you letter, it is obvious you already know that you have committed a criminal act. Please don't make it worse be committing more fraud.

From my understanding there is nothing else you can do - except file the returns.

On the I-864 (affidavit of support) you are required to list your income for the last 3 years. You are also required to submit at least the last years tax return (either the return with supporting documents or an IRS transcript).

If I am understanding your train of thought, you are thinking if you get a joint sponsor you might somehow be able to skip over this item. Not so. You will still be the 'sponsor' - you cannot have a 'joint sponsor' without a 'sponsor'.

So basically as I see it you either file the returns or you cannot be a sponsor and therefore cannot submit a petition.

That said, the instructions on the I-864 also state that if you were not required to submit a return (for instance you made under the - I think it's is around $3300 mark) - you have to provide evidence as to why you didn't file and back that up with the IRS instructions for same. This does not mean that at some point they won't ask you to file a tax return anyway (USCIS). If they don't think you qualify to not file, they will ask you to file the return before proceeding with your case.

For the record, the moral turpitude issues relate to the immigrant, not the petitioner. I'm not sure you can successfully petition from prison but you can once you're out. Not you, you but any you.

A person who retires early with more than three times the annual income requirement in assets can use assets instead of income to qualify as sponsor. Could that possibly apply to you?

If not, you'll need to state income for three years, and file at least one year's tax return to qualify as the sponsor.

The rest is between you and the IRS. We're not here to judge people on how they deal with their taxes. We're here for mutual support.

I believe if your yearly income is less than $8,450, you are not required to file a federal tax return.

When you file I-864 you would put down your income for each of the last 3 years and then have to write the IRS code whatever it is that states you are not required to file. You then can use your assets in place of income to qualify to be a sponsor provided you have some. Otherwise you'll need a co-sponsor.

If your assets were required during the years you did not file and its considerable, you should get a tax accountant or get advice from a tax attorney and file late returns.

Otherwise, you probably should not apply for sponsor visa.

Hopefully you weren't on welfare and working the system then you can file tax returns for the last 3 years or forget about it!

Just get a GOOD accountant and it's a piece of cake.

This question is just on tax returns. My 2006 returns were joint with my previous husband, does it that make a difference or since they know I was divorced in 2007, it is obvious I would have this type of tax return.
