Hello there!

I really need help regarding my personal circumstances.

I’m a Spanish national living and working in London for the last 12 years. I hold a UK residence permit.

My husband is a U.S national. We were married 3 years ago and we were both living in the UK.

Unfortunately due to a lot of problems our marriage broke down and we are now on the process of getting a divorce.

When things were going well in our marriage we started a visa for me so we could relocate to the US. We got a letter confirming the application had been accepted however things started to go bad after that and we never filled in the necessary forms or went to interview as well as getting my medical check up to complete the procedure.

I have a new partner now and my husband is now back in the US.

My new partner is a U.S citizen also living in the U.S. We have been friends for many years and he was very close to me during my marriage breakdown, my husband didn’t treat me very well and all my friends including my current partner where extremely close to me during this hard period. That is how my current partner and I we fell in love and discovered we are just right for each other and we have both found our perfect match.

We now wish to marry and live in the U.S after my divorce is through.

My husband wants a letter from the attorney who was dealing with my resident visa back in London confirming the case has been dropped and I will not pursue a visa on his name (a bit silly of him thinking I would do anything like that since I’ve already applied for the divorce, but he is paranoid). I’m providing him with that letter.

As many couples in here, my partner and I don’t wish to spend a long time apart, we have grown very fond of each other (I’m currently in the U.S visiting, I have been here for a month but departing back to London tomorrow morning).

We went to an immigration attorney in the U.S who explained I can come back on a waiver visa , get married on the “spur of the moment”, re-adjust my immigration status and apply for AOS.

We are now considering the possibility but my fears are since I was already married to a U.S citizen in the past and we started an application for a resident visa (even though this was never taken forward as I previously explained), I feel this might have a negative effect on our new application if we decide to get married and re-adjust my immigration status as the immigration officer might see it as a marriage of convenience.

We have witnesses who can verify our relationship, letters, e-mails and pictures together.

Can anyone out there give us some advice please? We would really appreciate. We are a couple in love who wish to start a life together.

Well technically, if you enter with the intent to get married on something other than a K-1 or Dual Intent visa. You will be committing visa fraud, and possibly run into trouble with adjustment of status.

However, it appears you decided to get married after you came to the US, so you could do what your lawyer is suggesting. But in case you are asked to prove that you had no intent, keep your return ticket and any evidence that ties you back to the UK. If you take this path, you will not be able to leave and return without AP. That takes 2-3 months to get after you apply to adjust status. If you do get married and leave (without AP), you can only return to stay on a spousal visa.

Since you say you "wish to marry" you could hardly honestly state that you "married on the spur of the moment" now, could you? Entering the US on the Visa waiver program with intent to marry and immigrate based on that marriage is visa fraud. People do get away with it but it is not advocated on this forum.

Facts are cheap...knowing how to use them is precious...

If you are both living in the UK now, the best option would be to do DCF if the consulate in UK allows it - I am not sure if they do. Else you can pursue the K1 or K3 options depending on when and where you want to marry. If and when you go for the K1 (or K3), you will have to prove to the interviewer that your relationship is valid etc. If you come here and try to adjust status then you have a bigger hurdle - to prove that you didn't intend to marry when you came here and if denied its a 10 year ban I think. The best alternatives would be DCF or K1/K3 in my opinion. Don't worry about a previous relationship, that has happened to many and you have to convince the interviewer that your case is genuine. Since you say you "wish to marry" you could hardly honestly state that you "married on the spur of the moment" now, could you? What happened with this case?

05/29/2008 --- Entry into the US on Visa Waiver to visit my girlfriend for a summer holiday and to help take care of her sick father where needed.

06/20/2008 -- After the sad passing of my girlfriend's father, we decided to get married and stay together

08/08/2008 --- We get married, lovely ceremony and dinner with all of Sarah's family present :-)

08/25/2008 --- AOS package sent to Chicago via Fedex overnight priority mail. Fingers crossed now!

08/26/2008 -- AOS Package received in Chicago, signed for by A.Smith (1 day before my VWP expires!)

09/02/2008 -- Checks cashed!!

09/03/2008 -- NOA1 received for I-485, I-130 and I-765.

09/05/2008 -- Case is shown online as pending!!

09/08/2008 -- Biometrics appointment letter received for September 23rd!! (For both I-485 and I-765)

09/12/2008 -- Biometrics walk-in completed, 11 days before the appointment! In Hackensack NJ.

09/20/2008 -- RFE for I-485 received. It was dated September 17.

09/25/2008 -- RFE response evidence sent out to Lee's Summit by USPS, certified mail.

10/02/2008 -- RFE response evidence received and case processing resumed!

11/04/2008 -- EAD CARD PRODUCTION ORDERED! Thank you Lord.

11/10/2008 -- EAD card received in the mail! wOOt wOOt!!!!

11/12/2008 -- SSN ordered from Hackensack, 2-4 weeks in mail!

11/28/2008 -- SSN Received in the mail, wOOt!!!!!!!!

12/7/2008 -- INTERVIEW LETTER RECEIVED!!! It's scheduled February 19, 2009 at 8:30am in Newark. *nerves*

2/19/2009 -- Interview 8:30am - Green Card verbally approved

2/23/2009 -- Welcome letter received! followed by I-130 approval notice!

Hopefully they got their divorce finalized and filed a K-1... coming back on VWP would be fraud and staying wasn't an option since her divorce wasn't finalized so she couldn't have married during the trip she was on when posting this.

Hopefully she goes the DCF route, otherwise lawyers tell ya to get your mate here marry on "THE SPUR OF THE MOMENT" hmmm...and then do AOS - bad bad lawyers. Anything to make money down the road when they are denied for obvious reasons and will definetly need a solictor!
