AUGUST I-129F FILERS UNDER CSC

Hi guys! i feel so blessed because my fiance mailed the I-129F packet sept 5, and he received the NOA1 sept 10. We filed it at the California Service Center. I don't know though whether the check has been encashed.

Let me be the first to say #######. So let me get this right......... my petition would have been processed sooner if I just held onto it for a month and then sent it?

Sorry foxyroxy - congrats to you ..... its the CSC that is causing me this grief.

May i add that instead of 4 processing centers there are now only 2. also if i may add, the 11 petitions filed in august are among about 4,000 or more other petitions filed in august to CSC.

not trying to poop on the parade, just trying to help you understand the reason for the delay

also to the OP. resubmitting your petition? That isnt going to help you, it will just cause you to lose another large amount of money (remember the fee isnt 170.00 anymore) and confusion within the USCIS.

i know it sucks to hear it, but patience is about all you can have at this time.

Hi babblesgirl and all,

We also have the proof that it was delivered. So I am sure they have our packages somewhere in their office unless they accidentaly trashed them! Oh that sounds like a really bad joke though...

So babblesgirl, are you gonna make any moves or you will wait for more while? I think we will need to wait for 90days to re-file it anyways.

I'm not looking to resubmit. At the start this really concerned me because it just seemed odd that the packet had been received at CSC but the check had not been cashed at all. After all, many people do not receive NOA1 hard copies but they do have their checks cashed!

Having done some research on this, there seem to significant amount of people who have submitted varying petitions at the same time as us who have not had checks cashed either and others who submitted later who ARE receiving NOA1's. I guess there are a whole lot of petitions, that were received mid-August, which they just haven't got to yet. The good news for us is that we are not alone in this. CSC will either get to us sometime and backdate our NOA1 receipt dates or have to cope with a huge number of us sending in delivery receipts if they have accidentally trashed them all (please no!). I'm assuming it won't be too difficult to prove that the fault lies at CSC's end. However, I'm hoping it doesn't come to that and I doubt doing anything before 90 days since we sent our petitions will be productive. :(

So yes, I am being patient for the time being. I hope we do all stay in touch. It will help during the wait to hear from each other when we do get updates and from anyone else who has an alternate experience because knowing there is a lack of consistency will assist us in the future if we do have to resubmit.

Thanks for your advice and information. I don't mind being told to be patient, I have come to that conclusion for myself. I will not resubmit, I agree it will probably just cause further problems.

Just to explain things a little. Initially it felt like *my* application had been lost, I was on the July filer thread (as I did file in July) and everyone, without exception, were getting NOA1's or had petitions returned for incorrect fee submission. And of course, I wondered what the hell was happening with mine. Clearly, I'm technically an August filer because the packet was delivered late and so I searched the August timelines to get some bearing on what was happening with those. I posted the topic when I noticed the gap in the timelines and realised that I was not alone...and that others may be just as worried as me and it might help to stay in touch with each other.

Since then, I have done a lot of research and realised that this issue doesn't just apply to me and the 10 other K1 applications I saw on the VJ timelines, it also applies to people submitting all manner of petitions to CSC. Not to mention the majority of applicants who don't even use these boards.

It is normal, I think, to expect your check to be cashed within five weeks even if you hear nothing else. Especially when most people hear something within a couple of weeks of delivery. So it's not a lack of patience so much as a concern that the applications have been lost. There is also a side of me that is comforted by the volume of applications in mid august that have not been looked at yet. It means there is a reason for this...and that I'm not alone.

I've found the best way to keep the lack of patience and increasing worry at bay is to keep yourself informed. Ask questions, talk to people, listen and find people who are in the same situation as you. Then we can all help each other.

There is still a slim possibility that ALL of us may have to resubmit at some point in the future. We know our petitions were received and that later petitions are being processed. So, if that day comes, a couple of months down the line, then we can help each other deal with that scenario.

You know it does help to know you are not alone. That's why I am here.

Also, I don't think that mid August applicants hearing nothing and the fact that many late August/September petitioners have already received NOA1's is easily explainable by the current backlog and streamlining issues. Except, perhaps, that they are processing boxes off the semi-trailer as they come to them and not by date received. Thank goodness USCIS have stated they will honour the received date on the NOA1, when it comes! ;)

My I-129F packet was received by CSC in Laguna Niguel, CA on August 22nd 2007.

It has been nearly a month and I have not yet received the NOA1.

Also, the check I used for payment has not even been deposited by USCIS.

I called the 800 number and asked if there was a delay on the NOA.

I was told that there has been delays and I cannot inquire about a specific petition not unless I have not received a notice after 90 days.

I am surprised to see that others are in the same situation here.

I thought that the NOA1 usually is received in 2-3 weeks.

I keep checking the mail and my online banking to see if there's anything. but nada.

I've already decided if something doesn't happen by the end of next week I am going to loose it. After that it will be 2 full months of nothing. Nothing as in no case number. Nothing as no identity within the system or progress forward. Nothing as in the petition might has well have just sat on my desk for the past 2 months.

We never received an NOA1 and as yet have not received the NOA2 either. Can you not get your case number from the back of your cashed cheque? If not then maybe call USCIS and get the case number from them. We never received an NOA1 and as yet have not received the NOA2 either. Can you not get your case number from the back of your cashed cheque? If not then maybe call USCIS and get the case number from them. I wouldn't expect much to happen for a couple of months but it is good to have a number so you can look up your case status on the website.

Thats what I am waiting on ..... 7 full weeks now and no cashed check.

Just wanted to let you know of our "progress".

We sent the I-129F to the NSC on 11th Aug while I was in the USA with Laura, it received and signed for on 13th Aug. Laura was told upon calling after six weeks without hearing anything that the Nebraska Service Center has a big back log and so our application was re-sent from there to the California Service Center for processing whereupon it could take up to 90 days for the NOA1 thereafter to be processed. We were told not to call again until 90 days had passed. California has informed us they are currently processing MARCH applications, but less than a week later our cheque was cashed, (27th Sept). Finally we feel as if the ball has started rolling.

I've just updated my signature below with this years developments.
