OK...I just received and RFE and it shows the following:

(40) The sponsor or joint sponsor (if required) on Form I-864 Affidavit of Support must submit the following:

- W-2's, 1099s, and/or all schedules submitted to the Internal Revenue Service (IRS) - a copy of his/her Federal income tax return was submitted and/or the sponsor requested an extension to file his her Federal income tax return.

.................OK what does this mean? I sent in a fully completed I-864 with copies of the last 3 years income tax!!!! He is a self employed farmer and I sent in ALL of it.

Anyone????

Oct 1/09 - I-751 package sent

Oct 3 - package delivered

Oct 5 - NOA mailed

Oct 13 - 1st NOA received and additional letters for my daughters I filed with. NOAs stated Resident Status

has been extended for 1 year and that we will be receiving a letter for an ASC appointment for

fingerprints, photo, and signature.

Dec 2009 - Received 10 year permanent resident card.

Feb 2010 - My children received their 10 year permanent resident cards.

Oct 2010 - My children were legally adopted by my USA Citizen husband.

Sounds like a rookie mistake by USCIS. I would order tax transcripts and send them instead.

Send it back in and include a letter explaining why there is no w-2 or whatever forms.

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

You should try to show that

1) He is self employed

2) Schedule Cs are attached to the tax returns to prove that

When I received my RFE it stated that any schedules had to be sent back in absence of W-2 (IE if the sponsor or immigrant is self employed). I would make sure you send any schedules as this is most likely what they are expecting. It won't hurt to send in transcripts again, either. If you call the IRS most of the time if you tell them what it is for they send it out for free, and by USPS so you can get it soon. Or if they are real nice they might fax it over.

You mentioned the tax returns but not W2s, 1099s and/or Schedules. A farmer would have a Schedule to submit and possibly 1099s. If these were not included that is what they are looking for, to substantiate the tax return copy submitted.

It probably wouldn't hurt to send in a copy of the I-864 you had already completed for their reference, but much more importantly, make sure to send in the RFE letter they sent to you. That is the reference to your file.

And, make sure that HE signs the letter that you include, for legally, they are only supposed to be communicating with him on his tax details. Sounds weird but I had something returned to me for this reason - even though we are married!

Don't get too frustrated by the RFE - I had one about a month ago and the frustration does indeed pass. If you send in a complete and detailed response via priority, you will only be set back by a couple of weeks, if at all. It is frustrating, but, like one of the people said below, their job is only to show that your guy can take care of you if you lose your job, and that you both won't be stuck on welfare. I am positive that if you show tax forms that indicate he is self-employed and has maintained a certain level of income for three years, you will be back on track soon. Much luck to you!!!

Aug 24: Received e-notice that EAD card was ordered (No more TN! yay!)

Aug 30: Last day of work on TN. Laid off from job. :(

September 5: Received Card! Just in time. Started part-time grad school today.

October 2007

Oct 2: Received Interview Notice: Whoo-hoooo!

November 27 2007

Had GC interview, which went smooth as silk. Received passport stamp, too.
