Ques. We had to submit paperwork to get the I-94 replaced and we still have not received a replacement yet. We received the green card in the mail a couple of weeks ago. The ques. is do we still need to have the I-94 replaced since we now have the green card?

2006/04/26- NOA1

2006/07/03- RFE received

2006/07/12- RFE received by CSC

2006/08/08- Touched

2006/08/10- Touched (additional info needed for case)

2006/08/11- Touched

2006/08/17- Received another RFE for evidence of meeting in past 2 yrs

2006/08/18- Sent back RFE to CSC

2006/08/24- CSC received second RFE

2006/08/25- APPROVED NOA2

2006/09/11- Letter in mail stating NVC is sending to Embassy

2006/09/12- Email from Embassy with pkt3 attached

2006/10/10- Pkt3 sent

2006/11/28- Pkt4 received

2006/11/28- Interview date

2006/12/04- Visa received

2007/01/03- Entered U.S.

2007/03/01- Married

2007/05/29- Biometrics appt in OKC

2007/07/23- Interview appt in OKC

2007/09/04- Green Card received

Forget about the I-94, it is no longer needed because you have a Green-Card. Lawful Permanent Residents are not required to fill out or carry an I-94 card.

i have a similar question then...we are getting married on 1 Oct. and his i-94 expires on the 10 October...is he plain out of status until we get a gc?

18 NOV 2010 Sent 1.8lb packet to USCIS in Laguna Niguel (day 1)

19 NOV 2010 Package signed for V SEMEGI (day 2)

24 NOV 2010 Package returned because USC didn't sign petition (day 6)

calendar reset

26 NOV 2010 Package sent out again (day 1)

29 NOV 2010 Package signed for by V SEMEGI (day 3)

29 NOV 2010 NOA1 issued (day 3)

03 DEC 2010 Hardcopy of NOA received (day 7)

07 JAN 2011 Successful walk in biometrics (day 42) original date 1 FEB

01 MAR 2011 Date on Approval notice (although it arrived after the card did) (day 94)

03 MAR 2011 Card received (day 96)

He won't be able to leave the US until he has AP or his GreenCard.

Yes, but having entered legally and fulfilling the terms of the K1 afford him the ability to apply for AOS, then he will be pending adjustment.

This is not a problem, you are required to get married withing the 90 days, you are NOT required to file for AOS within the 90 days. Any period of being out of status is forgiven upon approval of the green-card.
