I would visit the US embassy in Lima Peru and maybe they could help you. But, I got married in Lima Peru but, I had my divorce decree from my previous marriage to show them. Also, you need to have everything translated. Good luck!

They are probably asking you to prove something that in spanish is called "Libertad de estado", this is a sworn statement where you declare, under oath, that you're single and legally able to get married. Sworn statements can be issued by notaries (at least that's how it works in my country) Maybe you or your fiance can get in touch with a Notary from Peru. Or maybe the Embassy can refere you one.

It's been a while, so I can't remember exactly what I did to cover this. Forgive me if I'm way off, but I think I called the Department of Vital Statistics in Topeka, KS (the state I live in now), and they did some sort of record search back five or ten years and provided me with a "certificate of no marriage" or something like that. I would just call your closest vital statistics office and see if they can do anything for you.

Also, regarding the translations, I would suggest having them done in Peru. My wife had all of our documents translated to down there for probably 1/5 the cost of what it would have been here in the States. She translated all of Erika's documents that needed to be in English for USCIS and my documents for our civil marriage down there. My lawyer was actually really impressed with how well the translations were put together and shocked at how cheap it was done for. If you're interested I could get the translator's contact information for you (just PM me if you are). She is in Lima.

interetsing.. we got our K1 in Lima in June, and I wasnt asked for that document.

Also, we didn't have anything translated and we had no problems at all. We had my husbands birth certificate translated, but they threw it away without even looking at it.

There are many notaries in Lima, just look for signs that say NOTARIA. Shop around a little, if you have time. the discrepencies in price vary wildly.
