Hi, after receiving a notice from the NVC that our file was incomplete, I wanted to send this note to students who may be filling out the I-864. If you received no W-2, you have to write a letter to the NVC stating that you received no W-2 for the tax year. Since you are not employed, you need to send a letter to the NVC specifically stating that you are not employed. These should go together with the I-864 paperwork with your case number written on them etc.

I'd like to add a bit more information here for graduate students. Sometimes we have weird funding-training grants, fellowships etc that aren't considered "pay" and so you don't get a W-2.

I just sent in my I-864, so I don't know if I'll get RFE's. I want to avoid that {fingers crossed}, so I included the following:

1. A copy of 1098-T, statement of tuition. For graduate student, this includes both your tuition payments and stipend.

2. Letter of employment from your department for each you are you a student stating your yearly compensation.

3. Representative pay stubs from each year (~3/year) in addition to the last 6 months' pay check.

4. A letter from me stating that I did not have W-2's because I am a graduate student, and that I've included information from 1-3.

I think/hope I've addressed the no W-2 form in my packet, but we'll see! I'll keep this topic updated if I get any RFE's.
