I-134 affidavit of support $$$$$

Hello all....I am trying to get things prepared for the next step...if we are approved for a K-1 visa or the option to provide a possible I-601 waiver. I need some help dertiming weather or not I will need a co sponsor for the I-134. I have viewed some info... to just follow the rules of the I-864????? I must be dumb :blush: but I dont get how to calculate the annual salary that will be required. I am head of house hold in the US and have one child. We are hopeing to bring her Daddy home soon. I think I need to make $21,462.00 a year for the 3 of us.....can someone please tell me if I'am correct. If it is correct...I fall short...I make yearly only $20,640.00. Thats if you calculate my hourly pay times 160 hours a month times 12 months. I have had to take some time out for 2006 and for 2004 for a medical issue and had surgery and was out on a FMLA and was only paid for 60% of my pay for 3 1/2 months and only for part of the time I was out on both ocations. I'm afraid they might go by the total yearly salery earned for those 2 yrs and that will really mess me up. If they calculate by my hourly pay and take in to consideration I am a full time employee 40hrs a week...will I then only be short by about 1,000.00?????? then does that mean that if I have 4,000.00 in my savings accout that I will pass?????? Can someone please help me on this mind trap....LOL....If I go solo...and they say I dont qualify...do I have the option to then submit a co/sponcer or thats it...I blew it and need to start all over again???? My real issue is that I know I will have trouble finding a co sponcer due to the fact that my family does not approve of my upcoming marriage. Some of us might know what I am referring to. You know the free ride for papers speech....blah blah blah....But all I can say is.... I love him Mommy...ok so HELP !!!!!!!!!! :help::help::help::help::help::help:

For the I-134, you only need to meet 100%. However, it is somewhat up to the consulate, or embassy to determine if you make enough for the support requirement. That form only covers the 90 days non-immigrant stay or until you file for AOS.

The more important one is I-864 which is filed with AOS. With that you have to meet the 125% requirement or you are out of luck. Assets can be used to supplement your income, but you have to take the value of the asset and divide it by 5. $4000 will only give you about $800 dollars as "income". If you can acquire more savings, you might be able to make it.

So it is better to get to 125%, that way we can fulfill I-1864 and I-134, AND THERES NO ISSUE

July 11th 2007 NOA-1 received date on NOA-1 (now at CSC)

July 19th 2007 NAO 1 Reciept date on NOA-1

Nov 21st 2007 NOA-2

Dec 13th 2007 - arrives at NVC

Dec 20th 2007 - leaves NVC on route to GUZ

March 10th 2008- P3 sent & returned

April 9th 2008- P-4

May 22nd 2008 interview

Tracking:

Filing to Noa -1 -13 days

NOA-1 to NOA-2 - 133 days

NOA-2 to NVC - 22 days

NVC Processing - 7 days

NVC to GUZ - 81 days

P-3 to interview - 73 days

Interview to visa - 10 days

Filing to visa- 341 days

There are 172 hours in a month (4.3 weeks/month). That will help a little bit. Also, if you work overtime regularly, you tax returns will show that. If that does not make the 125%, you might want to work another part time job for a while.

7/21/07 - Check FINALLY Cashed!!!

7/24/07 - Finally got receipt number off the back of cancelled check!

11/23/07 - Our first ever touch!

11/27/07 - Touched on website

11/28/07 - NOA2!!!!!!!!

I-129f was approved in 160 days from your filing date.

12/21/07 - Received at NVC and assigned case number!

12/27/07 - Case forwarded to USEM

01/04/07 - Case received by USEM

02/25/08 - Scheduled St. Luke's Medical Appointment 7:00 AM

03/03/08 - Interview at USEM APPROVED

That is correct. The shortcut is the hourly times 2080. That's 40 hours times 52 weeks.

I worked for the state government with federal regulations for food stamp program, medical, etc. - - the feds us the following formula - - - take four consequetive paystubs if paid weekly, two if bi-weekly, total and divide by four - then multiply by 4.33333 - that will help you get closer to the required income - - - - remember to use the gross earnings - not the net!! good luck!!
