K1 and EAD stamp at POE

A member here posted that they had driven all the way to the Peace bridge to get an EAD stamp which was not given when he crossed. In pursuit of his stamp, he made an infopass appointment and was referred to Boston and was able to acquire the stamp .. soooo.......

I tried to do the same though I'm in a different area. I did not get the stamp at POE Peace Bridge and I made an infopass. The lady really didn't know what to tell me and acknowledged the discrepancies with the system and gave me the Cleveland airport immigration number to call. They called me back and the guy told me that because I got married the day after I got here that my K1 status changed to an immigrant awaiting permanent residence. That is the reason he gave me for not being able to give me the stamp. Because I got married ... I'm so confused ...

07/28/07 - Filed AOS,EAD, and AP for me and AOS and AP for my son via UPS .. received 08/01

08/16/07 - applied for ssn

09/03/07 - received ssn card

11/07/07 - AP approved and received 11/12/07 :)

11/19/07- EAD approved online and received same day (actual approval 11/07/07) :)

12/27/07 - AOS transferred to CSC

02/26/08 - 485's approved without interview

01/14/09 - Sent I-751 - removal of conditions

02/23/10 - Biometrics

03/17/10 - Removal of conditions approved .. card production ordered

If you don't get a stamp the offices will just tell you to file for an EAD, I have yet to see a post from someone saying that they got an EAD stamp at the local field office.

That really doesn't make much sense. I'm trying to think of an option for you and can't. it's a pretty long trip from Cleveland to Boston, so probably not worth trying.

05/14/2009 -- Green Card expired.

05/23/2009 --- Check cleared bank.

05/26/2009 -- Received NOA (NOA date May 15, 2009, guess they aren't deporting me).

05/29/2009- Biometrics Notice date

06/01/2009- Received Biometrics Letter

06/18/2009 - Biometrics

09/23/2009 - date of decision to approve (letter received), just waiting for card. No online updates whatsoever.

Yes it is a far drive ... I would call Detroit which is only a 2 hour drive but the immigration guy at the Cleveland airport confused me by telling me that as a K1 I was eligible to work but when I got married my status changed and therefore I am no longer eligible and must wait for EAD.

This doesn't make much sense to me. You still have a valid I-94. And if you had the stamp the day before you married and filed, you wouldn't have to stop working because you were now married and on a different status. And getting married itself doesn't actually change your status. Filing AOS does. (If it did, we WOULD get the green card along with the marriage certificate.)

Have you tried calling another office?

We didn't go to a local field office for the stamp. We went to the 'deferred entry' area at Boston Logan International for the stamp.
