I am glad i found this site.

I came here to the US on a K1 visa with all the intention of marrying my fiance. And now that i am here i discovered something about him. he is nice but he both likes men and women which i cant accept. We have a heart to heart talk and i told him that i dont want to share my man with anybody including guys. I m so glad he is an understanding type. Now, i start working at his friend's business and we talked about him hiring me to work in his business. is it possible for his friend to petition or sponsor me on a working visa???

i am really confused and i need help.

any advice you guys can give is highly appreciated.

Sorry to hear about your situation.

unfortunately , it looks like you are ineligible to change your status from the K1 visa.

i am sorry to hear about the situation you are in now , but you can't stay in the US without changing status on your K1 which is only possible if you marry the man who is named on your K1 Visa in your passport in the timeframe they gave you at the embassy i believe it was 90 days , otherwise your Visa expire and you are here Illegal . You can not change the K1 visa to a working visa !!!!! maybe you can talk to your man again and you both figure something out ? Good Luck !

Its possible that a company can petition you for working visa but as we know it will undego processing too and it will take time. So if your K-1 visa is already expired, you need to go home and wait for your work visa to be approved. The only way that can keep you from going home is to marry your petitioner.

No, you must marry the petitioner within 90 days or leave the USA. There are no "transfers". You start over again with any new visa process. Once a K1 visa is used, it's "expiration date" is meaningless. The 90 day clock begins on the date of entry and the visa is dead.

You may marry whomever you are free to marry but only marriage to the original K1 petitioner will provide you the legal status to remain in the US past your 90 day window.

You cannot transfer a K1 to anyone else. It is only valid for the man who WAS your fiance.

You can however, return back home and then file a new petition, either for a K1 (Fiance Visa) if you are engaged to another man, or you can marry, return home and file for a K3 (Spousal visa).

I'm not sure how you can become engaged or married to someone else so soon, but that's not for me to judge. It could cause some red flags with your new petition potentially. How long ago did you arrive here?

4 June 2005 CPR 2-year Green Card arrives in mail

REMOVAL OF CONDITIONS - 3½ MONTHS

8 May 2007 - I-751 sent to CSC - 23 August 2007 - Approved - Card production ordered

30 August 2007 - 10 year Green Card received

K2 TIMELINE (Stayed behind in UK to finish school)

28 March 2005 - embassy interview & medical London - visa granted

01/18/06 Applications for AOS/EAD sent - 03/28/06 EAD approved

4/3/06 - RFE for AOS - requested new medical and vacc supplement

4/26/06 - approved without interview and welcome letter sent

If you entered on a K1 and the relationship fails, you cannot remain here legally on said K1. Eventually, it will expire (the I-94) and you be out of status. You came here to be with a fiance, now that there is no fiance, there is no reason acceptable to USCIS for you to remain here. Spousal petitions do not work with a K1 who entered the US to marry someone else - you must return to your country and start the visa process, whichever you choose, over again.
