Totally untrue. The marriage is recognized as legal and all property agreements are and will be enforceable as long as the contract isn't contrary to US law.

If the contract isn't recognized, the marriage wouldn't be either.

They are enforcable as far as property but they do not have any kind of codecil with waivers of representation. If you want to see the difference between the two, you need to consult with an attorney with a copy of your islamic marriage contract and then ask the attorney if somehow an islamic marriage contract can be automatically converted into a divorce settlement without the husband present. It with absolutely no hesitation that I will say that although an islamic marrriage contract will handle financial matters it certainly has no waiver of appearance and waiver of court council in it, 2 very important things that an post nuptual has to have to enable a disgruntled wife to be able to enter a court of law and divorce her husband without his presence or him being represented. I have actually been in a court with one of these and was able to extricate myself from a mena man who battered me and my child and he was unable to over turn it nor stop me from divorcing him because he had already signed this agreement 2 years before ( he signed under borderline duress because after several incidents I wised up and had him sign it or I told him I was leaving) He continued the things he was doing and I finally had enought and went into court with the post nup and was divorced without him even knowing what hit him. I too had an islamic wedding contract but unless I was enforcing a maher, who cares about that. What I am talking about is protecting a woman who is married to a mena man already and has serious reservations about continuing with him but wants an alternative to outright leaving him ( to give him another chance without completely leaving him)

Your advice is usually right on Peezy but in this particular subject you are WAY off base . An islamic wedding contract is NOT going to enable a frightened American woman with a womanizing or abusive mena man to easily extricate herself from the marriage. A post nup will. I would advise any woman who has reservations about her husband ( mena or not) to pay the 100 and consult an attorney about post nups. If the attorney speaks French or Arabic ( French for North Africans) all the better. If not you can find arabic translators certified in the USA who can translate a document. This is NOT a document that you can easily do for for yourself like a will because of the fact that there are things that can be put in to allow you to go to court and divorce him without his permission ( My ex had a big eye opener when I was able to leave him and he could do nothing to stop me) Thats why a carefully written post nup is an amazing thing. Now for women who are confident in their husbands this is NOT AN ISSUE. But if you have married someone and you are just not sure about them and your stomach has some butterflies and stuff isnt adding up but you dont want to go all the way through to a divorce, this is like the emergency break before a divorce. An islamic wedding contract can be enforced for financial things. But it wont settle the answer and appeal, right to a trial or waiver of appearance... Sorry ,,, it will not .. Only a post nup can do that and it has to be written CORRECTLY or it wont work either.

07/22/07 - interview consular never bothered to show up for work.

Well obviously what I meant was they should NOT have gotten married, technically speaking ;)

what should have happened and what has already happened are 2 very different things. The reality is that only the woman can really know whether she is seeing red flags and danger signs into the marriage. If nothing else , having an option like the post nup is at least comforting to someone already in a problem that is not sure they want to leave and they want to give the person another chance.

I can't say what is going to happen, because I don't know at this point. I believe that everything happens for a reason, tho somtimes that reason is not so obvious. Maybe it was never meant to have been, and this relationship was sent to me to open my eyes about myself, and about others. Before I met my husband, I was clueless about the ME and it's people. I was one of those people that knew it existed, but to point it out on a map, no. My trail of thought followed popular belief about the ME, everything there was crude and old, the people less than murderous heathens. I was such a fool.

Because of this journey, I have seen the beauty of Jordan, and of it's people. I have stood in Petra, awed at it's timelessness and beauty. I have stood on the streets of an ancient city that has seen so much progress and growth, yet retain it's integrity. I have seen the love and closeness that the families there have for each other. I have learned that to be Muslim, does not mean that you are a bad person, or that you hate America and all it stands for. I have made friends I may never have met in this life. And I have loved a man again, with all my heart and unconditionally. I had thought never to feel that emotion again, my heart was frozen and with him it thawed again. Without him, I may never have had any of this, so I do not regret one moment.

I still love my husband. I am still in love with my husband. I don't know if that will ever change, but sometimes, you get off track. I don't know if it can be repaired, or if either of us will even want to try.

For those of you still going thru this journey, I wish speed upon the consulates. Time and distance are not a friend in the visa journey. May all of you be blessed with the richness that each of us deserve, love, and patience.
