We are partway thru the K-1, with many thanks already to the wonderful folks here.

However we have a problem. My US fiancee's sponsor has pulled out and she cannot be swayed :( There is no one else my fiancee knows who has the financial support available and is willing to help.

There is no way she is going to be able to earn the money to cover 125% of the poverty guidelines either - she has taken on more hours but she is basically 'unskilled' (thats a horrible term but I dont know how else to put it!) and as such unable to bring in the money required. Almost half of the income she currently gets is child support from her ex...

I understand some people have scraped through the London Interview on small amounts of personal savings, but the AoS will still provide insurmountable problems. I am a house owner and even as the prices start to drop here I expect to make at least 20,000 uk pounds profit on the place, but was not planning on selling up till the AoS had been completed, or if it was necessary to get thru the AoS to sell it and use those funds to prove I would not be a liability on the state.

I am due to send the papers to the London Embassy to arrange the interview, but without this financial issue sorted is there even any point? I've been throught the medical which was booked prior to the sponsor bailing on us, we're so close and still so far :( Any suggestions would be very warmly welcomed...

Its been 13 months since I've seen my loved one, and the frustration over this is driving us both mental :help:

Many thanks

Rey

2 possible options

Have your fiancee move to the UK to live with you. Maybe move back in the future on a spousal visa.

Look into the possibility of self-sponsoring. Since you cant count on income, you will need a significant amount of assets. Not sure if your house would be considered enough.

Does she reach the 125% if you include the child support? if so include that, oh and maybe sell your house now if not. I dont see a timeline, so i cant say what you will be using which tax years. Other possibility is to find another co- sponser. Hope this helps

Here is another option. Your US fiance can get a job. Easy to come by to make 17,000 a year which puts you in extreme poverty.

This way he would not have to impose on relatives nor friends.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Child support is not income.

Depends on your education, experience and where you live. In a city it may not be as difficult, but in a small town it could be.

I think she has children ( dont know how many) changes the numbers ($ required )if you have dependants and of course you can include child support as income, its money you get. put a attachment to file which shows child support money, ie bank statements, letter from bank showing how much money has been deposited in last year. Be creative

I would love for her to join me in the UK, however she has 3 children (2 living with her) and we dont want to interrupt their education. Relationships with their father are bad enough for them not to want to go there, and I wouldnt force that...

Selfsponsoring requires somewhere around 100k USD I believe and I will not be even close to that. If selling the house and everything here is required I will go with that, however it would be foolish of me to do so without being as close to 100% sure as possible that this would be enough. The UK house market isnt exactly in a wonderful state atm.

As mentioned she (the US petioning fiancee) does currently work, and has taken extra hours, but is nowhere near the required income -even including it she was $5000 a year short and working full time.

I do obviously plan on getting employed as soon as is possible within the US, and whilst only earning 18K+ here in the UK I have enough skills to get sorted fairly quickly - however this is not possible till the AoS and the provision of the green card as I understand it...

Many thanks for the input :) I'll have another go at the timeline, last time I tried, it crashed out on me...

You need to read this I-864P, Poverty Guidelines, if she has 2 dependant children ( so household of 3)125 % poverty line is $ 21,462

You need to include the fiance as a dependent though, which would make four, which would be $25,813.

Heya folks,

We knew the poverty guideline required ($25,813), she's just not able to meet it on her own. The third child is at college in another state, and also registered as living with the father, so have excluded him. Just wish we could push this forward and feel so helplessly hopeless atm...

I don't see whether you have answered this previously answered question:

Does she qualify with the child support? It CAN be counted as income as long as it is documented.

Insofar as using assets to qualify, the rule for the I-864 (which is not used at this stage of the game but if you can come to this point you should be golden), the requirement is THREE times the shortfall.

Example - if your fiancee earns $20,000 per year, and the pov guideline is $25,000 for your family size, you are short $5,000. You would need to show assets in the amount of $15,000 to make up the difference.

That makes far more sense and would be doable. I believe as her child support goes through a third party agency it will be documented and thus included in her income.

My personal assets whilst not huge, would easily cover the $15000 with the sale of the house, so this is the clarification we've been hoping would be the case. It did seem very shortsighted any other way...

Many many thanks for this, just the pickup we needed. Shes currently organising her bank statements etc so we'll know exactly where we're at very soon :)
