anyone know where i can quickly find out what 125% of the poverty line is???

Ok, nevermind, I found it. HOWEVER, I am about to freak the hell out because my co-sponsor's most recent taxes 2005 do NOT meet the 125% standard for a 6-person household.

Now...my husband and I live in this house, but we are NOT listed as dependants on my mom ((co-sponsor's)) taxes. So that would make 4, minus us 2.

So since we're not listed as dependants, does that mean we're not part of the household?

5/23/03: Justin arrives to visit me in IA from SK.
6/7/03: We got married!
8/23/03: Filed I-130 from SK
8/25/03: Phoned border guards & asked if J could escort me back to IA, yes.
8/26/03: Arrive in IA
8/27/03: Went to USCIS local office to ask if J could stay in the US and file papers, yes
2004: I-130 approved!
6/05: Filed AOS/EAD
7/2/05: Rec'd receipt for I-485
8/05: Rec'd RFE for Biometrics
9/9/05: Rec'd RFE for medical
12/2/06: EAD APPROVED!
12/5/06: EAD card rec'd
1/15/06: AOS interview date for 4/11/06 at 11:00 a.m.
4/11/06: APPROVED!!!!!! NO MORE USCIS FOR 10 YEARS!!! WOOHOO!!! 2016...seems more like a page # than a year. Haha.

I believe it must be the number of people on the sponsor's tax return (4) plus the immigrant (1). So your co-sponsor needs to be at 125% of the poverty line for 5 people. Not entirely sure though, do the directions not say?

Oh, and if you have income, then I think your income counts also, and you only need to be at 125% for two people ... so maybe they add together somehow? Sorry, I guess I'm not much help.

the instructions say "number of persons living in your residence, including yourself, not including the alien. So we have 5. then on line 5 of the I-864 it says total household size, which is 6. So we have to use 6??? i don't know.

Okay, here is my better question:

my mom's income exceeds the 125% standard. However, she filed a joint tax return with her husband & his income & farm loss makes the total income on line 22 NOT meet the 125% standard.

We are NOT using her husband as a sponsor, though. Can my mom's income on line 7 be the only one considered even if she filed jointly?

God, I hope so. Any help is greatly appreciated.

we are only submitting my mom's W2s, also to clarify. her total income on the W2s exceeds the 125% standard.

so i'm guessing it will be fine since my stepfather is not our sponsor, just her.

any thoughts?

Yes. She must include copies of her own W-2 anyway if her husband is not a co-sponsor (which it sounds like he couldn't be). If it's a joint return and only one of the people is the sponsor, it's based on the W-2s.
