aloha,

i will get right to the point - we follow the process to the tee (thankyou visajourney), then we receive our apointment date for biometrics and then 2 weeks following biometrics our appointment for aos. (btw, we were k1 fiance visa, then married after her arrival in usa).

so after a very quick and painless biometrics appointment in honolulu, we return to our home on maui. the next day my wife gets a call and a family emergency requires her immediate return to her home country. we rush back to her country, miss our aos appointment, thus forfieting our aos application.

so now my wife is stuck back in her country, and i guess now my only option is to start all over, but this time by way of k3 visa as we are now married.

is this in fact our only option? my wife is devastated, but she'll be coming back, right?

SORRY FOR THE CONFUSION - after my wife made it to the USA, family emergency neccesatated her immediate return to her home in cambodia. unfortunately before she was able to adjust her status, thus the case was abandanded. we now are filing both k-3 (married in usa) and have petioned both i-129f and 1-130 .....so, our "journey" has once again began. thank you for all your help and understanding - appleegg and sreyon.

interview @ tampa, fl office: april 26, 2007

green card received: may 5, 2007

removal of conditions timeline:

03/26/2009 - received in VSC

07/20/2009 - card production ordered!

You did know that if she left on a K-1 before AOS is approved without AP that your application would be abandoned?

With such short period to have an AOS interview she really couldnt wait at least to get emergency AP ?

You did know that if she left on a K-1 before AOS is approved without AP that your application would be abandoned?

With such short period to have an AOS interview she really couldnt wait at least to get emergency AP ?

Water under the bridge. Yes, there are two options. File an I-130 and I-129F together and go the K3 route. It might save a few months but will be far more expensive than just filing the I-130 and going the CR1 route.

may i ask, what exactly is "cr 1" ? - i have not had any luck finding any reference to it here on the site. and would you know the pros and cons of either route? cost versus time?
