Advice regarding filing time I-751

Hi All:

My husband's 90 day window for filing the I-751 to remove the conditions on his residency starts today. Do you think I will have any problem if I don't file it until around the 10th of October? With the increase in fees and all that works better for our budget. (Of course it would be better for our budget if the fee hadn't basically doubled!)

Thanks for any advice you can give.

Kat,

That is still within the 90-day window so your husband will probably be ok. Just be sure to use the correct form version, send in adequate evidence and the correct fee. Hopefully, by then the backlog from the deluge of applicants who tried to beat the fee increase would be out of the way and the service centers are "back to normal" in terms of sending out NOAs. Be prepared, however, of possible delays in getting the NOA that extends your husband's LPR status.

08/21/08: TSC cashed check

09/02/08: Received NOA...........Priority date: 08/20/08

09/02/08: Received Biometrics Notification

09/18/08: Biometrics completed - Charlotte DO

10/24/08: Received Interview Letter

12/08/08: Interview @ 1:00pm. APPROVED!

01/05/09: Oath Ceremony 10:00AM. Now officially a USC!!!

Normally it probably wouldn't be a problem but it appears that the service centers have experienced a huge increase in paperwork do to the last fee increase so you might want to keep that in mind. Good luck :thumbs:

I filled my orginal packet out on 21st July and then got it back as i had accidentally sent a photcopy of the I-751. i sent it back on August 8th. As of today (12th Sept) My check has not been cashed or NOA sent. My card expires 13th Sept.

13 June 05 Case Completed

23 June 05 Case Sent to London

11 July 05 DOS says Electronic file has been entered!!

11 July 05 Visa file at Embassy

3 Aug 05 Email with Interview date!!!

5 Sept 05 Medical in London 0840

8 Sept 05 Interview at London Embassy 1000

13 Sept 05 Fly to US

03 Oct 05 green card and SSN arrive YEah!!!!!!!

13 Dec 05 Ethan 1 year old

26 Oct 06 Keira Born

13 Jul Start preparing I-751 packet

21 Jul Mailed Packet to Nebraska!! (Via Express Mail)

23 Jul Packet received @ Nebraska

7 Aug received Packet back as had sent photocopy of I-751

8 Aug Sent back I-751 with original form and all other evidence

13 Sept Received NOA1

26 Oct Biometrics appointment 11/21 Seattle

21 Nov Had Biometrics appointment at Seattle

13 Dec Received notification that greencard has been ordered!!!!
