Hi everyone ! Well here is my question....After finally getting my fiance into the states on March 9th, we got married on the 14th. I have not yet filed for her adjustment of status due to the expenses of the wedding. We did marry within the 90 day period of entry to the states. Her K1 visa expires on the 9th of August but I plan on submitting the papers this month. I guess my question is if there is a specific time limit to submit? or does she have until the visa expires? I imagine that since we are married it would buy me some more time?

General consensus is that it doesn't matter how long you wait but she can't leave the country or more correctly she will be denied or banned if she tries to re-enter the country even on AP. Best to file AOS as soon as possible. Then she can try to get her life back to normal! Good Luck

We got married 6 days after me entering the US, and we didn't get AOS filed until 2 weeks before the 90 days were up. So it took a while, but we were fine.

You said you intended to file this month, that would make you all set as long as you really do. The quicker you file, the quicker she will be able to work and get on with adjusting so its in your best interest to do it sooner rather then later but the USCIS wouldn't give you hassle for the timetable we are talking about here.

Timeline:

11-15-2005: Sent in I-129F to VSC

11-21-2005: NOA1

11-29-2005: NOA2

12-05-2005: NVC recieved

12-17-2005: Packet 3 received from Dublin

1-11-2006: Sent packet 3 forms, etc. to Dublin

2-03-2006: Interview Date :)APPROVED!!!

2-05-2006: Flying to Logan Airport

2-11-2006: Wedding Date

3-14-2006: Filed AOS and EAD

3-22-2006: NOA1 (AOS and EAD)

4-07-2006: Biometrics

6-07-2006: EAD approved!!

7-24-2006: AOS Interview APPROVED!!!

7-27-2006: Received Welcome to America letter

8-03-2006: Green Card Received :)

Congratulations on your wedding,

You have completed the major requirement of the K1 visa, as such there's no need to worry,

IMPORTANT: I think you are CONFUSING the K1 visa date with the I-94. The K1 visa is a single entry visa that unable your fiance to travel here, once she's here now it's no longer valid, YES you do have some time to fill out the adjustment of status. As long as you fill it out before the 90 days on the I-94

The other posts are correct as long as you are married within the 90 days you are fine to file past the 90days. We sent in our paperwork about a month after the K-1 expired because I was waiting to file my 05 tax return since they ask for 3 years of tax info.

As the other posts state, the sooner you file the quicker you get your life out of limbo. As you see it takes 30-90 days to process the EAD and from 120-180 days to process the AOS. For us we are waiting to get the EAD which might not be until May And AOS may not be done until August.

My husband is in limbo keeping busy being a housewife.

Thanks for the response...my question is is it 90 days from the time she enters USA? Or 90 days from the marriage to submit paperwork?

You need to marry within 90 days of the visa date. If you did that, then you're fine on putting in the AOS any point thereafter. Ideally you should not delay this process any more than is absolutely necessary but others have had delays from time of marriage to filing without much consequence.

26 January 2005 - Entered US as visitor from Canada.
16 May 2005 - Assembled health package, W2s.

11 July 2005 - RFE: cheques inappropriately placed.

The k1 visa is usually valid for 90 days as entry in the US ....

You have to file prior the 90 days are up.

Good luck

You can file whenever you want just so long as you marry within the 90 days.. I waited quite a few months.. although i haven't had my interview date yet i haven't had any problems thus far...
