Hello,

Please help. I am filling application for permanent residence through marrieage with USA citizen. On form I-130 that my husband needs to fill, on part 14b there is question :Did you gain permanent resident through marriage to a US citizen..?Since he was married before to US citizen, and that way got green card, and now he is citizen already for 2 years what we need to answer.There is just yes or no?

On the form I-864 at part 10 (Enter the total number of immigrants you are sponsoring on this form from Part 3, Items 8 and 9) we put 1.But I am cofused with part 5 Persons you are sponsoring in this affidavit, we enter number from line 10 which is 1.

Persons NOT sponsored in this affidavit:

b. Yourself.

c. If you are currently married, enter "1" for your spouse. If we put again 1, because we are married that come out like 3.

I am compitely confused with this.

What do I write?

Also, I came on J-1 visa (two years home requirement does not apply), and after two years before my I-94 expire I applied to change status in B-2 (tourist visa), and was denied.

Then I got married to my boyfriend so I am now married and out of status. I am not sure do I need to send them notice that visa was denied. Please help if any one in same situation.

Sounds like YES is the answer doesn't it?

What do I write? First of all, YOU don't write it, your USC spouse does, but regardless - if it is just husband and wife, the number is 2. One (1) from line #10 and One (1) from line 21b (21c would be used if a married couple were sponsoring a child or parent etc - someone other than you).

Also, I came on J-1 visa (two years home requirement does not apply), and after two years before my I-94 expire I applied to change status in B-2 (tourist visa), and was denied.

I don't think you need to tell them it was denied. Just send copy of your I-94 and they'll know how you came in and that you are now out of status.

From what I remember you cannot go from a J1 to a B2 (unless I remember wrong ;) ) so it's not too surprising that it was denied. You can get J1 extended, get an H1B, but not extend as a tourist, you already get 30 days after the end of your work/internship locally, they estimate it's enough to visit around.

08.2006: Entered with a B-2 visa.

So I am gonna just write current status: out of status, and that should be fine. Do you know anything how letter should looks that I have to send that is Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship?

The rules are said in the guides though

Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage);
