Well we sent off our evidence yesterday and what was sent was the following..........

- I-751 and fee

- Copy of front and back of greencard

- Lease agreement for 2006 and 2007

- Copies of trips taken together with entry/exit stamps of that country

- U.S.P.S. P.O. Box lease (joint)

- Studnet loan application showing my wife as reference

- 4 months worth of bank statements plus a copy of the checks we use

- 2 affidavits from friends

- Joint Sams club membership

- Joint video store membership

- Joint magazine subscription

However, since we didn't make enough we couldn't file taxes, IF we get an RFE asking for joint tax returns, how do we overcome that and explain the situation???? what form would need to be filled out? an affidavit? sworn statement?

The same case goes with the car, because its under her mum's name, and of course no life insurance because we don't make enough to keep a monthly payment of that either.

The water and electricity only comes under my wifes names, so thats why we didnt send that either.

Its just that i see people who have sent in their tax returns such as Silvanski and he got an RFE and to my opinion he had more evidence sent off than we did.

With what i sent in? is it sufficient or can i expect an RFE???

Seems you send a lot of good evidence, but like Kez says, it would be a good idea to file with the IRS asap (besides, you could get a refund!).

Good luck, L.

He and his wife are residents of Puerto Rico -- they do not pay federal income tax. I believe there is a commonwealth income tax in Puerto Rico (the equivalent of a state income tax), which is probably what he was referring to when he said they did not make enough to pay taxes.

Meh
