GUN PURCHASES

SB940 tightens safeguards against the sale of handguns to mentally ill buyers, expanding the types of information that hospitals and mental health facilities must forward to the Illinois State Police for background checks.

The measure was in response to the mass shooting of students and faculty members at Virginia Tech in April by a mentally ill student.

The measure prompted some soul-searching among people like state Rep. Brandon Phelps, D-Harrisburg, one of the Legislature's most vociferous gun-rights advocates. Phelps voted "no'' on the bill when the Illinois House passed it 108-7 in May.

Phelps said Tuesday he is filing a request to have his vote officially changed to "yes,'' in part because the National Rifle Association has since signaled it doesn't have a problem with tighter screening of potentially mentally ill gun buyers. The law goes into effect June 1, 2008

Well, I'd guess if you'd been admitted to a hospital for any sort of mental illness, been diagnosed and in treatment...that's a start. That doesn't account for the thousands and thousands of people who never get treatment though. All joking aside, I think we all know individuals who have undiagnosed mental health issues that probably shouldn't be the type of person going into a gun shop. It's scary to think they can get one.

So, yeah...can we be TOO safe and scrutinizing when it comes to a freakin gun??

Personally I think there are way too many guns out there in the public's hands, but I'm sure the gun lovers out there will go ape on me for that statement, but whatever...it's my opinion.

i know Phelps the one listed as changing his vote due to the NRA...i am from that part of illinois..and you have to be pro gun..to get elected as a outhouse cleaner....

i know, working on psych wards, this has been the case....sounds like they hace expanded it to include all admissions instead of those with psychosis...

The problem I have with this isn't the gun control issue. My bigger problem is allowing a backdoor for this information to be used in police investigations. It is also a powerful disincentive for gun owners to ever seek medical treatment that would remotely be related to mental health (marriage counseling, for instance).

I haven't seen the full text of the bill, but from what I have found, it gives the State Police the right to ALL mental health records, and the choice to forward whatever they like to the FBI. I don't think that I am comfortable with that.

A better solution would be for a judge to issue such an order precluding someone from buying firearms, and have that sent to the state police.

i agree brother russ...there is a invasion of privacy and hippa ...illinois state law always required psych admisisons for certain mental health diagnosis be reported to the state police..i had many clients ahve their gun card revoked ..and sometimes, guns seized or have to ransfer to a relative who ahs a valid gun card..this now, increases the information to the state police..plus, looks like all psych admissions...are reportable..so, i f a new mtoher has post partum depression , she probably loose her gun card, if admitted for a bried hospitalization...

but, does not include admissions for chemcial dependency issues

Prretty common for police and soldiers. They don't worry about losing their jobs though (they generally need firearms).

If a doctor or a judge determines that you should not have a gun, I'm fine with that. Giving police blanket access to records is not the solution though, as I don't believe that they are qualified to make such determinations. (so called "may-issue" states generally give out gun permits based on the political opinion of police cheifs, nothing more.)

I don't think that all medical records should be available to the police though. There is nothing preventing the police from using this information for other nefarious purposes. Political smear campaigns, etc. If a doctor read you miranda rights, would you say a word to them? Kind of ties their hands in terms of how much they can help.
