Just got married! Very happy. We did a K-1 visa and are Now filing for AOS. Here's my question:

Is our petition for AOS going to be denied because I don't have a job yet?

I had lived abroad with my fiancee (now wife) for years but I haven't found a job in the US yet. We do have the following things going for us:

1. Very good co-sponsor

2. I am employable at a good salary and would certainly have a good job by the time the interview came 'round.

3. I had a good job abroad and can (actually already have) proved it

Anybody with similar experience/knowledge of this sort of thing care to chime in?

As long as you have a sponsor and/or co-sponsor then that won't matter; you won't be denied on that basis.

Congrats on the wedding and best of luck,

Your fine, what they want to see is that there is someone who is financially responsible for the new immigrant, they don't really care who it is as long as it follows the rules.

Also by the time you get the interview you can fill up a new affidavit of support and bring it with you along with letter of employment & pay subs from the past 3 to 6 months. It's always a plus.

I am in a similar situation. My Wife is a USC and she was working when she sponsored me abt 2 yrs back. Now she is not working however i have been working all this time. So the delay in my I130 & I485 is due to this situation apart from my pending name check? Any solution for this problem. We also went through our interview abt and year and half back.

Thanks for the input.
