From what I have read, commonly if you have not yet sent the aos package in, you can file the ead with it (chicago). If it does not arrive within 90 days than you can schedule an infopass appointment at your local ins office to get an interim ead.

For your wife to get her EAD and SSN you will need to file for AOS....

As she came on a K3 your wife can not get a SSN until she has EAD and she cant file for EAD before she has filed for AOS.....

It will take about 90 days to get her EAD from the date of the NOA for EAD if after 90 days she has not got it she can apply at the local office for an interim EAD..

Everything has to be filed to the Chicago lockbox not your local office...

You don't need to file for AOS in order to file for an EAD when you entered the US on a K-3. The K-3 beneficiary can apply for an EAD base solely on the K-3 status, no adjustment of status is necessary. See the VJ FAQ on EAD at the link below.

You have to mail it to Chicago, but then appointments and I THINK the actual processing takes place locally

11-15-2005: Sent in I-129F to VSC

11-21-2005: NOA1

11-29-2005: NOA2

12-05-2005: NVC recieved

12-17-2005: Packet 3 received from Dublin

1-11-2006: Sent packet 3 forms, etc. to Dublin

2-03-2006: Interview Date :)APPROVED!!!

2-05-2006: Flying to Logan Airport

2-11-2006: Wedding Date

3-14-2006: Filed AOS and EAD

3-22-2006: NOA1 (AOS and EAD)

4-07-2006: Biometrics

6-07-2006: EAD approved!!

7-24-2006: AOS Interview APPROVED!!!

You have two options you can file to Chicago, or you can do it online. As far as I know you can't do it at a local office.

Perhaps in your case. We were able to get a Social Secuirty Number 2 weeks after my fiancee arived on a K1. We did not apply for an EAD until about 2 months later.

Read the thread topic again. This thread is about K-3. You came on a K-1. The AOS and EAD procedures are different for a K-3 beneficiary.

As your wife came in on a K3, she can apply for an EAD even if she does not file for AOS (yet).

Larry, You need to have your wife apply for her EAD through Chicago. She does not need to apply for AOS prior to doing this. My husband went to our local office and asked if he could apply locally (just in case) and was told to apply through Chicago, which he did. At his biometric appt he was not asked about AOS. He asked them if they would give him an interim EAD while waiting just on the off chance....as I am pregnant and have had a history of problems with pregnancy he wants to work as soon as possible. He was told he had to wait until 90 days to apply for Interim EAD.
