CR-1 approved before K3/K4

:help: needed please. We filed I-130 in order to file for the K3/K4 visa, and planned to file the I-130 for our child after entering the US at the same time as the I-485...........but the I-130 has been approved :dance: What do we do about the I-130 for the child? If we file now, will they attach it to my application, or do we have to wait until I enter the US on a CR1 and then file for the child? :unsure: Edited by RMHurd

It seems CSC has speeded up dramticaly..................so i think i would send it now!!.................You have nothing to lose doing this as you would have to file it anyway, your K3 will probably get approved any day now too............that once approved is realy fast through London!!!................

You could send the I-130 for your child & hope its fast like yours was, you can slow yours down at NVC until your childs catches up with it!!

EDITED to say...................I came to the US on a K3, and am returning to England for my CR1 interview on the 28th April................could this be an option for you too?

April/04/2005- Visa journey began!!

We did both K3 & CR1 visa's, got both!!- I returned to England for my CR1 interview after first arriving on a K3 visa!!

May/25th 2006- Green card arrives in the mail................YAY!!

19th June 2006 I Had to go to the Social Security Office to get my number, the DS-230 didnt work for me!!

26-June-2006- Social Security# arrived in the mail....YAY!!

Feb 2008 lift conditions <<<reminder to self!!<<<< went to England for a visit instead, no rush right, 90 days is a long time,LOL

Removing Conditions Begins

Mailed I-751 April 12th 2008

signed for @ NSC April 16th

NOA date April 16th

Conditional GC expired May 5th 2008

Biometrics Detroit May 10th 2008

10 year Green card ordered August 20th 2008

Citizenship any time from feb 2009

Thanks euro, the child is an 11 year old dependant, listed on the I-130 as a relative of the Applicant. Don't know if that makes a difference, I'd really like to know if the I-130 application for the dependant child can be done in the US because she is a dependant, or if I have to do it now as a completely separate application?

If the I-130 runs well, we will not do the K3/K4 route.

I'd really like to know if the I-130 application for the dependant child can be done in the US because she is a dependant, or if I have to do it now as a completely separate application?

Does the child have a legal way to enter the US (taking into account the eventual desire to immigrate, which rules out using any tourist visa or VWP)? If so, the I-130 can wait until after entry, and can be filed with adjustment of status. If not, you may want file the I-130 right away, so the child can get an immigrant visa. That would also avoid the adjustment of status paperwork and hassle.

When the spouse's I-130 reaches the consulate, the K-3 is not available to the spouse anymore, so the K-4 becomes unavailable to the child. If this happens, it can leave the child with no way of entering the US, other than starting from scratch and filing an I-130 for the child to get an immigrant visa.

The child will eventually need the I-130, so you might as well file it ASAP.

The child can't "tailgate" and get an immigrant visa based on the parent's I-130, the way the parent's I-129F can be used to get the child a K-4 visa.

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Thank you.......it's taken a long time for us to understand this, but we do now. We will enter on K3/K4 and file the I-130 for the child at AOS. My I-130 is at NVC and will not progress it any further, so the K4 is not in any danger of being abandoned. :thumbs:
