Thank you guys for all the inputs and advice. Lizzy is right I pressed the wrong key and I had the smiling face showed up which is not suppossed to be, with the problem we are facing right now. I don't know how to change it being new is this forum. Hope you all understand.

I just like to add more to my earlier post regarding my denied k-1 petition. I was able to talk to my fiance and according to him, he received a document stating the reason why it was denied and enclosed, an Appeal form encase we still want to continue with the application. My fiance admitted he made mistake on returning back the papers when he was asked for an additional docs, which is, his divorce decree he sent it not yet certified by the registry of records (now he got a new one certified). The bottom line is, he did not comply to the requirement. We are now considering on consulting an immigration lawyer to help us out get it fix. I don't know if we will do it right this time. Do you think consulting an immigration lawyer the best way to do. I believe it will cost us a lot but we want it fix so we could be together soon. I know that this is just the first step and the hardest part is applying for the visa. If I was able to get the step by step guides to file the K-1 Petition earlier, we could have avoided this problem. It was only this time that I got it when I was searching the internet for an answer and made my way to visajourney.com and to this forum. I am very thankful that God brought me to this site and to the people behind this forum, you're all great. May you continue to give and share your views/advise/inputs to the people who need it most.

Good luck with your appeal, I know it's stressful, but if you follow all the instructions you should be alright :) You probably can do it without a lawyer, just follow the instructions in the denial letter and submit the missing document, but if you don't feel confident enough and not sure what you're doing then talking to a lawyer would be a good idea. I hope you will get your visa approved soon!

If you feel more confident using an attorney then you should, however on reading the instructions for I-290B Notice of Appeal form it seems an easy enough process to file. Included on the form, you write a brief reason for the appeal and then you submit this with the evidence (the divorce decree certified by the registry of records) and the fee. You must do this though in the time it stipulates.....30 days from memory. And it must be sent to the service center that denied the petition.

Can you please explain who is who? Who is the U.S Citizen (USC), and who is the fiance(e) in the Philippines? Now I'm not sure who didn't have the appropriate Divorce certificate... the USC, or the fiance(e) in the Philippines!

In addition, now it sounds like there was an RFE, but the proper documentation was not supplied, which is the reason for the denial. Please explain what exactly happened.

Other than that, contacting an attorney just might be the right thing to do in your case, as it sounds like things have gotten rather complicated.
