Has any one else out there had to wait for FBI Clearance before going for AOS Interview. I have been waiting over 1 year, I received my EAD within 8 weeks of sending the paperwork in. After numerous letters to my local Immigration office, they do telephone to tell me they are awaiting FBI clearance and cannot do anything. Getting a bit fed up with them and it seems as though I am powerless to do anything. Any ideas? :help:

We went to the aos interview and didnt get the green card because of the background check as well, been six months since the interview and 10 months since the original fingerprinting.

I think our next step is to write to the congressman, so tired of waiting....

Does anyone out there have a "sample" letter of what they wrote to their congressman while awaiting!!

Would truly appreciate it.

Didnt think you had to wait for the interview because of the background check, only heard of that happening after the interview....Truly messed up system...

I don't know if you can push along the name check status with the FBI. There were other postings earlier on this forum (search for them probably in conjunction with 'Carina' because there was someone who had that in their signature who responded to the one I'm thinking of) saying that there's really not much you can do to push. Personal inquiries aren't allowed. Congresspeople and their offices can make inquires of the name check process but usually can't do anything if it's stalled.

We are waiting too, not for long but our AOS interviewer said that all was well and the card was on the way. Don't know why we had to be mislead. Reading all these stories is making me depressed.

My question is, my wife came here on a K-1. Wasn't her background checked BEFORE she came into the country??? It makes more since to me to check it then before she has the chance to enter the country and run away (thats what they are afraid of right?) What could they possibly be doing now that couldn't/shouldn't have been done before.

If its just a way to make time pass so they can determine if our marriage is "real" or not, I can understand (standing the test of time). But at least let her be a real person in the meantime. Give her status, let her work if she can find it, let her travel, enable her to get ID cards, etc. Its just a terrible situation and I'm still answering questions from friends and family "Isn't she a citizen automatically because she married you?"

darth - No, they don't do a thorough check for the K1 process - no fingerprints are done (they just review the police clearance and do a namecheck (possibly.)) But now a complete fingerprint check and another name check are done - so it is different.

Ha ha - no marriage doesn't make them citizens only birth does! So, if she was to have a child - the child will be a US citizen born to an ASA (adjusting status alien!) We are also waiting - Good Luck

I didn't realise everybody else was going through this ####### too.

I had my fingerprints taken back in mid-December and AOS interview at the start of March and was told that there was no problem and Green card was approved pending the results of the security check.

I was a bit stupid though and had never applied for EAD because of the employment authorisation given on the I-94 when I entered through New York. Well at the AOS interview they take away your entry stamp of course so I had to give up work and apply for the EAD so its back to the waiting game and finish off tidying up the basement.

My wife now introduces me to everybody as her "house-######".

Rhymes with "hitch"

Jan 10th 2005, I-129F sent to NSC

I just checked my FBI biometrics via the phone you can call the FBI centre and get the results and they will tell you if its been done and sent back to the Immigration place I had to Ring west Virginia.Im not sure if West Virginia is the correct place for you to call though ring your local FBI and tell them you want to check the stautus on your biometrics. When contacting WV They asked me my name and date of birth and the A number. The Lady on the phone said to me" that they had done it that same day and it had been sent back to immigration" .

Hope this helps

I've reached that realistic age where I have to choose between having fun and a heart attack :)

Do the 10 digit fingerprints also go through the FBI as well?
