Did we file too late in July?

Did we file too late in July? We got our packet back saying to pay the new fees and asking to resubmit with the correct fees. :crying:

We mailed it on July 30th. I though somone here said as long as it is posted marked by the 30th it will be ok.

So we got the I-797C, Notice of Action saying: NOTICE TYPE: Rejection Notice on what was sent back. Recieve date: August 01, 2007

recieved @ CSC: 5-5-06

NOA1 mailed: 5-16-06

RFE 6-23-06

RFE mailed 8-7-06

Approved NOA2 9-07-06

Approved NOA2 email :) 9-11-06

Interview 02-01-07

AR lifted 03-14-07

visa delivery 03-17-07

Flight to USA POE LAX!!! 04-20-07 Welcome to America!

CIVIL MARRIAGE 04-27-07

SSN Applied for 05-18-07

AOS PREP TIME!!! ??-??-??

K2 interview APPROVED

The post stamp had to be before July 30th at the latest, not July 30th, meaning the last date to mail it was effectively July 28th since the 29th was a Sunday. Lots of people (including myself) mailed it on the 28th and had no problem, but from all I've read here, it was my understanding that mailing it on the 30th was too late.

Timeline:

2005-04-14: met online

2005-09-03: met in person

2007-02-26: filed for K-1

2007-03-19: K-1 approved

2007-06-11: K-1 in hand

2007-07-03: arrived in USA

2007-07-21: got married, yay!

2007-07-28: applied for green card

2008-02-19: conditional green card in hand

2010-01-05: applied for removal of conditions

2010-06-14: 10-year green card in hand

2013-11-19: applied for US citizenship

2014-02-10: became a US citizen

2014-02-22: applied for US passport

2014-03-14: received US passport

Why did you cut it so close? Now you will have to re-submit with the new fee.

Yes it was too late. But take a deep breath and remember that now the AP & EAD are included in the fees, so if you didn't file for those before, do so this time. Might as well make the best of the new fees.

I have the same problem. My application was postmarked the 28th of July but I just received a rejection notice from Chicago saying that I had sent insufficient funds. It shows on the rejection notice that they received it on the 30th of July. Please provide clarification as to whether this is correct. I thought that as long as your application was postmarked before the 30th then the old fee would be acceptable.

Yours should be fine, MrsWilson.

I would return it to them with a new (brightly colored) cover letter stating the rules - and proof that your package was postmarked prior to July 30th.

I think the AILA has suggested something similar to their clients.

I believe, though, that the OPs was too late.

for clarity -

yes but, in this case (the OP) the rejection of the package is apppropriate. Rejection of a package with a post stamp prior to July 3th is not appropriate.

Hi,

we filled on 30 july too and we got the same rejection on 10 sept. notice to send the all package again with the right fees.I have a question now for you guys who had to fill again because of wrong fees.Did you just sent the all package with the same application forms or did you download again the forms? I had just downloaded new forms for I-485, I-765 and G-325 a, i completed and signed again, but the other copies from mariage certificate, I-94, birth certificate etc...i sent them back just like this even if USCIS put some marks there with a pen or stamp, so i sent the same papers i din't make copies again.I am wondering if i did right? :unsure:
