Hey!

So today we received a Request for Initial Evidence for the i-130/i-485 package we submitted in July.

They have requested federal tax transcipts from the IRS, which we have already submitted. I understand that they often ask for stuff again, so not a big problem.

However, the problem is that they state that the income for 2006 was insufficient (it is!) , but that the current income is sufficient, and that we should submit evidence. of current income.

The income stated on her 2006 tax return was $18962, above the 125% line. She has no dependents, it is just the two of us.

Should we contact them?

Also, it states that I cannot accept interim employment until 90 days after they receive the evidence from me. So thats another 90 days until I can work???? I have my biometrics tomorrow, I was hoping to work soon :-(

Thanks!

William

I would say send a new I-864 add a letter from the employer and pay subs from the past 3 to 6 months as additional evidence that you are good for this year.

From what I've read around it's just a 'disclaimer' (I think that's the right word), what usually happens is that they resume your case as soon as they receive the requested documents, do don't worry get things together and send it. You should receive a receipt from them saying that they got it.

I'd send in a letter to USCIS, indicating that this is your income as reflected on 2006 tax return and that it exceeds the poverty guidelines. I'd also add in a bunch of paystubs and a letter from the employer.

RFE doesn't really slow thinks down that much. If you delay in responding to the RFE, then that can slow it down, but processing pretty much resumes where it left off (or in my opinion somtimes faster) when the RFE was issued.

That's good to hear, thanks all.

The tax return document we sent them was a print-out of the "report" screen at CitizenTax.com (the return was filed online). I wonder if this is an issue - maybe they want an certified one? We have ordered them, but they take 2 weeks. The letter we received does refer to the "federal tax return you submitted..."...So I am thinking that the document are correct, but what they want is us to resubmit them PLUS the extra evidence of current income.

I wish they would be more clear - I can only imagine the stress that the whole process would cause before places like visajourney existed! It is already stressful enough!!

Cécy - do you think it is necessary to submit a new I-864?

Just make a copy of the one you already sent. it's just so they have everything together and no excuse that they lost something else.
