K2 will file I-751 seperately but K1 divoriced-help!

Hi,

I entered US 10 month later than my Mom(K1) and got my conditional green card about 11 months later than hers as well. Now I need file my I-751 but my step Dad already divorced my Mom who received her 10 years card right before divorce. Is there any problem with my I-751 case?

Anybody can help? Many thanks in advance.

No this wont be a problem with your case, you should be able to file to lift conditions on your own.

7.4) ..How to we file for lifting of conditions for my K2 child?

A..If your K2 achieved permanent resident status at the same time as the K1, or within 90 days afterwards, then include them on the joint petition. If the K2 achieved permanent resident status more than 90 days after the K1, or if the parents are NOT filing a joint petition (due to termination of the marriage), the K2 will file their own I-751.

Thank you for your reply. I am still not sure if it's ok if I don't have sponsor to sign my I-751. I wonder if there's anybody here ever has the same case. Thanks again...

Joint sponsor requirement only applies to husband/wife situations.
