Can the AOS be sent without the medical exam? can the medical exam be sent later?

My wife's religious visa expires on October 15 of the year. She had an appointment for the examination with the medical surgeon but the surgeon canceled. She got another appointment for the 26th of September. They told us that the results will not come until four weeks after the exam (Health Department Surgeon). My wife's visa will be expired after the results of the exam will come. Does anybody has some advise? I will appreciate it. Thank you.

Yes,

i sent my AOS without the medical exam, and i dint get any refuse on it .. But wait i am on k-3 visa. i dont know about u .. But also ! when i received my letter for my interview they ask me to bring it with me i mean the medical exam .. so i have to get me 1 before i go to my interview, and wait!! i see some people get REF, on it too.

wait for another posts maybe some one else will come and add something could help u ..

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

The Civil Surgeon is telling you to wait 4 weeks for results? That seems very odd, most people get them the same day or next. You should send in a complete AOS package if you don't want to have problems with RFE's down the line. I'd say find a different CS and get the medical & complete all the paperwork for AOS.

Don't send incomplete AOS package, anyone who suggests you do that is wrong.

Overstay are usually 'forgiven' when you file for AOS through marriage. So if you want to avoid RFE you can wait a little bit. Do try to see if there are any other CS in your area that can take her in earlier and try to have as much as you can done earlier (TB test by your doctor, getting all the vaccination documents, etc).

Or you can send what you have now and wait for 1/ a RFE or 2/ been asked to bring it to the interview.

It's really up to you.

PS: by the way, it only took a week for my results to be available as soon as they have everything. Try to talk with the CS to see why they say it will take so long.

Thanks for your input. The surgeon if from the health department. The attendant say that the lab is don't through the state lab in Nashville, TN. I know it's odd because their charge is a normal surgeon charge. What is an RFE?

RFE= request for further evidence.

It means that the USCIS sends you a letter to request documents that they need for your file (either not sent, or they lost it). It will delay the process of the application until they get what they asked for.

Is the Surgeon one from the list of approved Civil surgeons.... I sent my AOS without my medical all that happens id you will get a RFE (request for further Evidence) asking you to send it.... it maybe slowed down my case by no more than a week.... But please double check that the doctor that is doing the medical is an approved Civil Surgeon from the USCIS list... you can find the list on the USCIS website...

Yes, the surgeon is one approved in the list. This doctor is at the health department at Chattanooga, TN. Thanks for the information. Do you recomend to send it? you people are very helpful. Thanks
