My wife and I lived together for a few years in Ukraine while I worked there, we married right before I left. After the year it took to get her a visa and to come here, we both realize that we've each changed a lot and would like to do other things with our lives.

She wants to go back to Ukraine where she has a good job as a journalist, and has no interest in keeping her green card or visa.

We don't have any joint accounts, or anything held together at all.

And neither of us are upset with each other and are actually still really close friends. We just are looking to see if it would be easier to process a divorce here, or just wait until she flies home (she's like to go in the next month or so) and have it done in Ukraine? She has only been in the US for 2 months.

Mostly, we're just looking for the swiftest way to get on with our own lives. She doesn't really want to wait around in the US for a lot of legal work.

Basically, I'm asking if there are fast, easy methods or getting a divorce here, or if we should just do it all in Ukraine (and has anyone done that?)?

Depends on your state of residence but uncontested divorces can be done fairly easily (even remotely) without personal appearances.. Check you individual state or county government website for information.

i think u can do it in the states.. but dont u see u guys so hurry to decide to get divoce now, and as u said she is been here in the state only just for 2 months.. i think u not change but i think the country change and the weather on her ... my opnion as u start that relationship in love dont end it easy. i am sorry i dont mean, but i feel so bad when i see a nice love story to collapse easy .. give urself time guys before to do it ...

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

some states have a summary divorce law (like Calif) where if you meet certain conditions (short term marriage, no kids, limited comunity property, etc.) you just fill out the forms and send them in. No court, no lawyers, etc.

Check your state laws.

I finally got rid of the never ending money drain. I called the plumber, and got the problem fixed. I wish her the best.

Agreed. Many states allow joint filing but in my case, that also meant both needed to appear and reaffirm their intention to divorce. If she wants to leave soon, you can probably just buy a divorce for dummies (or something like that) for your State, file and serve her the papers. Then when the cooling off period is complete, you'll get a divorce decree you can send her a copy of.

Facts are cheap...knowing how to use them is precious...

The OP is in CA (that's what the profile says), therefore, eligible for a summary dissolution of marriage:

But there's still a 6-month waiting period in CA, even with a summary dissolution:

If only one party appears at the divorce hearing, it will suffice. It will be assumed that the second party has defaulted and accepts the court's decision no matter what it is. If it's an uncontested divorce, it's not an issue.

If you live in California an uncontested divorce is fairly simple but it will still take six months for a final from the court. If she doesn't want to be here have her go home, she doesn't need to be here if you have no property or funds to split. Good luck :thumbs:

What State do you live in?

That helps a lot as how to instruct you how to file and what to file.

December 12 2006 Filed I130

Jan 10 2007 got receipt and case number!

Jan 12 2007 sent 129F

Feb 6 notice they were moving the file to a faster service center.

Feb 26 Notice of I130 approval

Feb 28 2007 notice they were sending 129F to USCIS for further investigation (err #######?)

May 15 2007 notice of approval of 129F with processing dates of 05/15/2007 thru 09/14/2007

May 28 2007 Notice from attorney that NVC needed processed and money orders were needed.

June 4 2007 Traveled to Manila to spend 2 weeks with my wife!! (YeHaaaa!!)

Fed-xed her signed papers (For NVC) from Manila to attorney from Manila while on vacation

June 18 2007 Nvc approved support.

June 29 2007 packet arrived @ my home informing of interveiw for I130 on Aug 27 2007 and explaining Medical interveiw.

(Note wife never received packet for I130 in Philippines I fed-ex'ed mine to her for medical interveiw)

July 17 2007 packet arrived for 129F setting interveiw for Sept 5 2007

August 5 2007 Wife flew to Manila for medical interveiw on August 6.

August 26 wife flew to Manila for I130 interveiw on August 27 2007.

August 27 2007 12:31 pm I130 Approved

Thanks a lot everyone. Yeah, I'm in California, so I'm going to look into the Summary Dissolution. And she's alright with that. She's just looking to head back and start up her career there again, so I think I'll just do all the stuff here like you advised.

As for the advice of trying to make it work and see how it goes... well, we're better friends than anything else. And she really doesn't like living here -- not that I really do either. I've spent the last 7 years overseas and am looking to get back to that lifestyle after this is taken care of.
